BYLAW - Amend By law 2213 78 (Stanjon Devel.) - 19960911 - 375896D(Stanjon Developments) THE CORPORATION OF THE TOWN OF AURORA By-law Number 3758-96.D BEING A BY-LAW to amend By-law No. 2213-78 WHEREAS it is deemed advisable to amend By-law number 2213-78. NOW THEREFORE the Council of the Corporation of the Town of Aurora enacts as follows: 1. That the provisions of Section 11.54 "Detached Dwelling Second Density Residential (R2- 52) Exception Zone" be amended by deleting the contents of that section and replacing them with the following: 11.54.1 11.54.2 11.54.2.1 11.54.2.2 Uses Permitted In accordance with Section 11.1 hereof. Zone Requirements Lot Specifications Lot Area (minimum) Lot Frontage (minimum) Siting Specifications Front Yard (minimum): 250.0 square metres 11.5 metres Main Building 5.0 metres Garage 5.0 metres Rear Yard (minimum) 1.0 metres Interior Side Yard (minimum) one or two storeys: on one side 0.6 metres on the other side 1.2 metres Exterior Side Yard (minimum): Main Building 3.0 metres Garage 5.0 metres Notwithstanding the above and the provisions of Section 6.2, where a detached garage with no rooms above is located in its entirety in the rear yard, the minimum required interior side yard setback for the main building shall be 3.3 metres on the driveway side and 0.6 metres on the other side. The minimum distance separation between any part of the garage, including eaves and cornices, and the interior side and rear lot lines shall be 0.6 metres. The maximum length of a garage shall not exceed 6.0 metres while the maximum width of the garage shall not exceed 3.0 metres, and the garage shall be excluded from the calculation oflot coverage. All other provisions of Sections 11.54 and 6.2 shall apply. Notwithstanding the provisions of Section 6.48.1, open-sided roofed porches, with or without foundation, may project 1.8 metres into a required front yard provided no part of the porch, including eaves and steps, is closer than 1.8 metres to the lot line. Where an open-sided roof porch, with or without foundation, is located in the front yard, the porch and steps shall be excluded from the calculation of lot coverage. 11.54.2.3 Building Specifications In accordance with Section 11.2.3. with the exception that the maximum Lot Coverage shall be 55.0 percent. 2. That Section 12.11 is hereby amended by deleting the contents of Section 12.11.2.3 and replacing them with the following: In accordance with Section 12.2.3 with the exception that the maximum lot coverage of all buildings and/or structures excluding open-sided roofed porches not exceeding one storey in height, with or without foundation, in the front and/or eXterior side yards shall be 40 percent and the maximum lot coverage including the open-sided roofed porches shall be 44 percent. 3. That Section 12.12 is hereby amended by deleting the contents of Section 12.12.2.3 and replacing them with the following: In accordance with Section 12.2.3 with the exception that the maximum lot coverage of all buildings and/or structures excluding open-sided roofed porches not exceeding one storey in height, with or without foundation, in the front and/or exterior side yards shall be 40 percent and the maximum lot coverage including the open-sided roofed porches shall be 44 percent. 3. No part of this By-law will come into force until the provisions of the Planning Act have been complied with, but subject to such provisions the By-law will take effect from the day of passing thereof. ALLJSON, MUNICIPAL CLERK Explanatory Note Re: Zoning By-law No. 3758-96.D By-law Number 3758-96.D has the following purpose and effect: To amend By-law 2213-78, the Zoning By-law in effect in the Town of Aurora, to amend provisions applying to lands located within Registered Plan 65M-3069 located on Pinnacle Trail in the following manner: Lots 19-26, Plan 65M-3069: To amend the provisions of the "Detached Dwelling Second Density Residential (R2-52) Exception Zone" to permit a reduction in the rear yard setback from 7.5 m (24.6 ft) to 1.0 m (3.3 ft), an increase in the front yard setback for the main building from 3.6 m (11.8 ft) to 5.0 m (16.4 ft), and an increase in the permitted lot coverage from 35 percent to 55 percent. Lots 27-78, Plan 65M-3069: To amend the provisions of the "Semi-Detached and Duplex Dwelling Third Density Residential (R3-9) Exception Zone" and "Semi-Detached and Duplex Dwelling Third Density Residential (R3- l 0) Exception Zone" so that the existing 40 percent coverage maximum apply to the main building and accessory structures but exclude single-storey open-sided roofed porches in the front and/or exterior side yards, and that the total coverage including the porches not exceed 44 percent.
