BEING A BY-LAW to amend
By-law No. 2213-78
Senator Homes
WHEREAS it is deemed advisable to amend By-law number 2213-78.
NOW THEREFORE the Council of the Corporation of the Town of Aurora enacts as follows:
1) THAT the zoning category applying to the lands shown in dark outline on Schedule "A"
attached hereto and forming part of this By-law is hereby amended from "Holding (H) Zone"
to "Environmental Protection (EP) Zone" and "Row Dwelling Residential Holding (H)R6-37
Exception Zone". ,
2) THAT Section 15 is hereby amended by adding the foilowing as Section 15.41 "Row
Dwelling Residential (R6-37) Exception Zone".

Notwithstanding the provisions to the contrary, lot area, yards and coverage
requirements shall be calculated on the basis of the entire site area including
the portion of the site zoned "Environmental Protection (EP) Zone".
Private Outdoor Living Area
Notwithstanding the provisions of Section 15.3.1.3, a screen wall and/or
fence with a minimum height of 1.83 metres and a maximum height of 2
metres, shall be provided on either side of the private outdoor living area to
a minimum depth of 4.0 metres. All other provisions of Section 15.3 shall
apply. ,

Landscaping Requirements
Notwithstanding the provisions of Section 6.2.2, a landscaped strip of a
minimum width of 5.0 metres exclusive of any buildings or structures shall
be provided along the westerly property boundary and shall only be used for
the purpose oflandscaping and shall include a black vinyl chain link fence
to a minimum height of 1.2 metres extending from the front property
boundary for a distance of 160 metres north along the westerly property
boundary.
Accessory Structures
Notwithstanding the provisions of Section 6.2.2, no part of any decks or
accessory structures shall be permitted to be set more than 4.0 metres from
the rear of the building.
Holding Prefix
Notwithstanding the provisions of Section 15.41 above, while the "(H)"
Holding prefix is in place, no person shall within the lands zoned (H)R6-37
as shown on Schedule "A" attached hereto, use any lot or erect, alter or use
any buildings or structures for any purposes except those uses which existed
on the date of passing of this by-law. Furthermore, no extension or
enlargement of the uses which existed on the date of passing of this by-law
shall occur, unless an amendment to this by -law is approved by the Council
of the Corporation of the Town of Aurora and comes into full force and
effect.
Removal of Holding Prefix
Prior to the passing of a by-law to remove the "(H)" Holding prefix from the
lands zoned (H)R6-37 or any part thereof, the Town of Aurora shall be
satisfied that a site plan agreement has been executed between the owner of
the lands and the Corporation of the Town of Aurora.
Upon removal of the "(H)" Holding prefix from the lands zoned (H)R6-37
pursuant to Section 36 of the Planning Act, R.S.O. 1990, or any successor
thereto, the provisions applicable to the said lands shall be set out in Sections
15.41.1, 15.41.2, 15.41.3, 15.41.4 and 15.41.5.
3) No part of this By-lawwill come into force until the provisions of the Planning Act have
been complied with, but subject to such provisions the By-law will take effect from the day
of passing thereof. ·

SCHEDULE "A" TO BY-LAW NO. 3779-96.0
Explanatory Note
Re: Zoning By-law Number 3779-96.D
By-law 3779-96.0 has the following purpose and effect:
To amend By-law 2213-78, the Zoning By-law in effect in the Town of Aurora to rezone the
subject lands as shown on the key map, being Part of Lot 81, Concession 1 W.Y.S., from
"Holding (H) Zone" to "Row Dwelling Residential Holding (H)R6-37 Exception Zone" and
"Environmental Protection (EP) Zone".
The purpose of the amendment is to permit the development of the lands for row houses to a
maximum of 27 dwelling units, to provide exceptions to the siting and building specifications of
the R6 zone and to provide protection to the environmental area.
The R6-37 zone includes the following exceptions:
• increase the lot frontage from 30m (98.4 ft) to 130m ( 426.5 ft), the rear yard setback
from 7.5 m (25.6 ft) to 56 m (183.7 ft), and side yard setbacks from 6.0 m (19.6 ft)
to 50 m (164ft) for the exterior side yard and 1.5 m (4.9 ft) to 10m (32.8 ft) for the
interior side yard;
• decrease the permitted lot coverage from 25 % to 15 % of the lot area;
• provide a landscape buffer of 5 m (16.4 ft) including a black vinyl chain link fence
and a minimum building setback of 10 m (32.8 ft) along the westerly property
boundary;
• decrease the length of privacy fence required from 6.0 m (19.6 ft) to 4.0 m (13.1 ft);
• restrict accessory structures and decks to be located no more than 4.0 m (13.1 ft)
from the rear of the building;
• increase the permitted height from I 0 m (32.8 ft) to II m (36 ft).
The By-law incorporates the (H) Holding prefix which, prior to any development, the (H) prefix
applied to the R6-37 zone must be removed which requires public notice but not further opportunity
for appeal. The condition as set out in the zoning by-law for the removal of the "(H)" Holding prefix
is the execution of a satisfactory site plan agreement between the owner of the lands and the
Corporation of the Town of Aurora.
The E.P. Zone is to protect the environmental protection area.

the Town of Aurora, passed by the Council of the Corporation on the 27th day of November,
1996, was given on the 12th day of December, 1996, in the manner and form and to the persons
prescribed by Ontario Regulation 199/96, as amended, made by the Lieutenant Governor-in-
Council under subsection (18) of section 34 of The Planning Act (1990). I also certify that the
20 day appeal period expired on 2nd day of January, 1997, and to this date no notice of appeal
of the By-law has been filed by any person in the office of the Clerk.
