BYLAW - Amend By law 2213 78 (Diamond) - 19960410 - 371196DTHE CORPORATION OF THE TOWN OF AURORA By-law Number 3711-96.» BEING A BY-LAW to amend By-law No. 2213-78 WHEREAS it is deemed advisable to amend By-law number 2213-78. Diamond NOW THEREFORE the Council of the Corporation of the Town of Aurora enacts as follows: I) THAT the zoning category applying to the lands shown in dark outline on Schedule "A" attached hereto and forming part of this By-law is hereby amended from "Special Mixed Density Residential (R5) Zone" to "Special Mixed Density Residential (R5-21) Exception Zone" and "Row Dwelling Residential (R6-35) Exception Zone". 2) THAT Section 14 is hereby amended by adding the following as Section 14.3.20 "Special Mixed Density Residential (R5-21) Exception Zone". Notwithstanding the provisions of Section 14.1 and 14.2, the lands shown zoned R5-21 on Schedule 'A' shall only be used for the residential buildings and accessory structures existing on the date of passage of this by-law. Notwithstanding the provisions of Section 3.42.3 and Section 14.4.1, for the purposes of the R5-21 zone, a Converted Dwelling shall mean a dwelling existing at the time of passing of this By-law altered to contain not more than two dwelling writs, each being a self-contained dwelling writ none of which is located in a cellar or basement. 3) THAT Section 15 is hereby amended by adding the following as Section 15.39 "Row Dwelling Residential (R6-35) Exception Zone". 15.39.1 15.39.2 15.39.2.1 15.39.2.2 Uses Permitted -row housing -private home day care Zone Requirements Lot Specifications Lot Area per dwelling writ (minimum): 160 square metres Lot Frontage per dwelling writ (minimum): 6.0 metres Siting Specifications Front Yard (minimum): -Main Building -Garage Rear Yard (minimum) Interior Side Yard (minimum): Exterior Side Yard (minimum): -Main Building -Garage I 6.5 metres 7.0 metres 7.5 metres 1.5 metres 4.0 metres 6.0 metres .•........ ... .... . ···-~-----~--------~-~"~---··· 15.39 .2.2.1 Notwithstanding the above, the minimum required setback from the common lot line between attached units shall be nil for the main building and the garage. 15.39.2.3 15.39.3 15.39.4 15.39.5 Building Specifications Floor Area (minimum) Lot Coverage (maximum) Height (maximum) 75 square metres 40 percent. 10 metres For the purposes of this by-law, where an open-sided roofed porch, with or without a foundation, is located in the front and/or exterior sideyard, the porch and steps shall be excluded from the calculation of coverage. All other provisions of Section 6.48 shall apply. Private Outdoor Living Area Notwithstanding the provisions of Section 15.3.1.3, a screen wall and/or fence with a minimum height of 1.83 metres and a maximum height of 2 metres, shall be provided on either side of the private outdoor living area to a minimum depth of 3.6 metres. All other provisions of Section 15.3 shall apply. General In accordance with Section 15.4 hereof with the exception that no more than five (5) units of row housing shall be attached in a continuous row. Parking Notwithstanding the provisions of Section 6.26.1.2, the minimum required parking shall be two spaces per unit and the required parking set aside for and visually identified as visitors' parking shall be nil. 3) No part of this By-law will come into force until the provisions of the Planning Act have been complied with, but subject to such provisions the By-law will take effect from the day of passing thereof. Explanatory Note Re: Zoning By-law Number 3711-96.D By-law 3711-96.D has the following purpose and effect: To amend By-law 2213-78, the Zoning By-law in effect in the Town of Aurora to rezone the subject lands, being Lots 7 & 8, Registered Plan 107 and municipally known as 94 & 98 Wellington Street East, from "Special Mixed Density Residential (R5) Zone" to "Special Mixed Density Residential (R5-21) Exception Zone" and "Row Dwelling Residential (R6-35) Exception Zone". The purpose of the amendment is to permit the development of the rear portion of the subject lands fronting onto Centre Street, for five rowhouse units. The two existing homes facing Wellington Street East are proposed to remain as either single detached or converted dwelling units, limited to a maximum of two dwelling units each. Exceptions to the R6 zone standards are as follows: a reduction in the minimum required lot area permitted from 230m2 (2,475 ft 2 ) to 160 m2 (1,722 ft 2), the minimum front yard building setback (Centre Street) from 7.5 m (24.6 ft) to 6.5 m (21.3 ft) for the main building and 7.0 m (23.0 ft) for the garage, the minimum exterior building setback (Walton Drive) from 6.0 m (19.7 ft) to 4.0 m (13.1 ft) for the main building and 6.0 m (19.7 ft) for the garage, and an increase in the maximum permitted lot coverage from 25% to 40%.
