BEING A BY-LAW to amend
By-law No. 2213-78
Macont
WHEREAS it is deemed advisable to amend By-law number 2213-78.
NOW THEREFORE the Council of the Corporation of the Town of Aurora enacts as follows:
1) THAT the zoning category applying to the lands shown in shading on Schedule "A" attached
hereto and forming part of this By-law is hereby amended from "Restricted Industrial (M1)
Zone" and "Service Commercial (C3-5) Exception Zone (Urban)" to "Service Commercial
Holding (H)C3-5 Exception Zone (Urban)" and "Service Commercial (C3-5) Exception Zone
(Urban)".
2) THAT Section 22 is hereby amended by deleting the contents of Section 22.6 and replacing
them with the following as "Service Commercial (C3-5) Exception Zone (Urban)":
Notwithstanding any provisions to the contrary, the lands shown zoned C3-5 shall be
construed as being one lot so that the provisions of this by-law shall apply collectively to the
lands within this zone, notwithstanding their division into two or more parcels.

Parking Requirements
Notwithstanding the provisions of 6.26.1, the minimum parking requirement
shall be:

Notwithstanding the provisions of 6.26, the minimum required manoeuvring
space for Vehicle Display spaces shall be nil, and for spaces associated with
the service centre shall be a miuimum of 6.0 metres. All other provisions of
Section 6.26 shall apply.
For the purposes of the C3-5 zone, visitor and employee parking shall include
spaces associated with the service centre, as identified on an approved site
plan.
Landscaping Requirements
A landscaped open space area shall be provided in accordance with the
following dimensions:
(a) Adjacent to Yonge Street-an average of5.0 metres and in no case
less than 3.0 metres.
(b) Adjacent to Allaura Boulevard-3.0 metres.
(c) Adjacent to the eastern boundary -no less than 1.5 metres.
(d) Adjacent to the southern boundary-no less than 1.0 metres.
Holding Prefix
Notwithstanding the provisions of Section 22.6 above, while the "(H)"
Holding prefix is in place, no person shall within the lands zoned (H)C3-5 on
Schedule "A" attached hereto, use any lot or erect, alter or use any buildings
or structures for any purposes except those uses which existed on the date of
passing of this by-law. Furthermore, no extension or enlargement of the uses
which existed on the date of passing of this by-law shall occur, unless an
amendment to this by-law is approved by the Council of the Corporation of
the Town of Aurora and comes into full force and effect.
Removal of Holding Prefix
Prior to the passing of a by-law to remove the "(H)" Holding prefix from the
lands zoned (H)C3-5 or any part thereof, the Town of Aurora shall be
satisfied that a site plan agreement and/or amendment has been executed
between the owner of the lands and the Corporation of the Town of Aurora
on the Phase I and Phase II lands.
Upon removal of the "(H)" Holding prefix from the lands zoned (H)C3-5
pursuant to Section 36 of the Planning Act, RSO 1990, or a successor thereto,
the provisions applicable to the said lands shall be as set out in Section 22.6.1
and22.6.2.

3) No part of this By-law will come into force until the provisions of the Planning Act have
been complied with, but subject to such provisions the By-law will take effect from the day
of passing thereof.

Explanatory Note
Re: Zoning By-law 3679-96.0
By-law 3679-96.0 has the following purpose and effect:
To amend By-law 2213-78, the Zoning By-law in effect in the Town of Aurora, to rezone the subject
lands, being Lots 1, 2, 3 and 4, Plan M-51 and municipally known as 1, 3, 5 and 7 Allaura
Boulevard, from "Restricted Industrial (Ml) Zone" and "Service Commercial (C3-5) Exception Zone
(Urban)" to "Service Commercial Holding (H)C3-5 Exception Zone (Urban)" and "Service
Commercial (C3-5) Exception Zone (Urban)". The purpose of the amendment is to permit the
development of the lands to the east of the two existing automotive sales dealerships for two
additional automotive sales dealerships. The by-law outlines specifics respecting lot, siting and
building specifications for the property in addition to site specific parking and landscaping
requirements .. The By-law provides that the (H) prefix not be removed until a Site Plan Agreement
has been executed for the eastern half of the subject lands; prior to the removal of the (H) symbol
the use of the lands is restricted to those uses existing on the date of passage of the By-law. The (H)
prefix applied to the C3-5 zone must be removed prior to development taking place which requires
public notice but no further opportunity for appeal.
