BEING A BY-LAW to amend
By-law No. 3604-95.D
Site Plan Control
WHEREAS the provisions of Section 41(2) of the Pt~ng Act R.S.O. 1990, as amended, provide
that Council may by By-law designate as a site plan control area, the whole or any part of an area
shown in an Official Plan as a proposed site plan control area;
AND WHEREAS the Council of the Town of Aurora had enacted By-law 3604-95.D on the 22nd
day of February 1995 pursuant to the provisions of the said section;
AND WHEREAS it is deemed advisable to amend By-law number 3604-95.D.
NOW THEREFORE the Council of the Corporation of the Town of Aurora enacts as follows:
1) That By-law 3604-95.D is hereby amended by adding the followingto the end of that by-
law:
The powers of the Council of the Corporation of the Town of Aurora under Section 41 of
the Planning Act, as amended, are hereby delegated to the Director of Planning for the
approval of plans and drawings and the imposing of conditions in respect of the following:
1. Applications for site plan agreement where the Director of Planning is of the opinion
that the use and development of the lands is considered minor in nature, and provided
Council is supplied with a sununary of any such application.
2. Amendments to existing site plan agreements where the Director of Planning is of
the opinion that the use and development of the lands provided for in the original
agreement remains substantially unaltered.
In the event that the terms and conditions set by the Director of Planning for the approval of
any delegated application are not agreed to, or for any other reason, the application may be
referred to Council.
The Director of Planning is hereby authorized to execute site plan agreements on behalf of
the municipality for those applications where authority has been delegated.
2) No part of this By-law will come into force until the provisions of the Planning Act have
been complied with, but subject to such provisions the By-law will take effect from the day
of passing thereof.
