BYLAW - Amend 2213 78 (Stewart,Jennings) - 19950628 - 364095DTHE CORPORATION OF THE TOWN OF AURORA By-law Number 3640-95.D BEING A BY-LAW to amend By-law No. 2213-78 Stewart/Jennings WHEREAS it is deemed advisable to amend By-law number 2213-78. NOW THEREFORE the Council of the Corporation of the Town of Aurora enacts as follows: I) THAT the zoning category applying to the lands shown in shading on Schedule "A" attached hereto and forming part of this By-law is hereby amended from "Detached Dwelling First Density Residential (Rl-13) Exception Zone" and "Detached Dwelling First Density· Residential (Rl-18) Exception Zone" to "Detached Dwelling First Density Residential (Rl-20) Exception Zone", "Detached Dwelling Second Density Residential (R2) Zone" and "Detached Dwelling Second Density Residential (R2-62) Exception Zone". 2) That Section 10 is hereby amended by adding the following as Section 10.22, "Detached Dwelling First Density Residential (R1-20) Exception Zone": /r 10.22.1 10.22.2 10.22.2.1 10.22.2.2 10.22.2.3 Uses Permitted In accordance with Section 10.1 hereof. Zone Requirements Lot Specifications In accordance with Section 1 0.2.1 hereof with the exception that the minimum Lot Frontage shall be 9.35 metres. For the purposes of the R1- 20 Zone, the Front Lot line shall be the line abutting Kennedy Street West or a reserve abutting Kennedy Street West. Siting Specifications Front Yard (minimum) Rear Yard (minimum) Interior Side Yard (minimum) -from western property line -from eastern property line 40 metres 11 metres 4.5 metres 12 metres Notwithstanding the provisions 6.2, the minimum Interior Side Yard for the existing accessory building shall be 1.3 metres. Building Specifications In accordance with Section 10.2.3 hereof with the exception that the maximum building height the existing accessory building shall be 4.5 metres. 2) THAT Section 11 is hereby amended by adding the following as Section 11.64, "Detached Dwelling Second Density Residential (R2-62) Exception Zone": 1 11.64.1 11.64.2 11.64.2.1 11.64.2.2 11.64.2.3 Uses Permitted In accordance with Section 11.1 hereof. Zone Requirements Lot Specifications In accordance with Section 11.2.1 hereof with the exception that the minimum Lot Frontage shall be 16 metres. Siting Specifications In accordance with Section 11.2.2 hereof. Building Specifications In accordance with Section 11.2.3 hereof with the exception that the maximum Lot Coverage for a one storey dwelling unit shall be 40 percent and the maximum height for the main building shall be 8.0 metres. 4) No part of this By-law will come into force until the provisions of the Planning Act have been complied with, but subject to such provisions the By-law will take effect from the day of passing thereof. Ol---~rn~-.J _J ~~-- ___ .......__ .... ~L--L _ _J__1":::"':'~ loooo..~ SCHEDULE "A" TO BY-LAW NO. 3640-95.0 'L Explanatory Note Re: Zoning By-law 3640-95.D By-law 3640-95.D has the following purpose and effect: To amend By-law 2213-78, the Zoning By-law in effect in the Town of Aurora, to rezone the subject lands, being Part of Lot 79, Concession 1 W.Y.S. and municipally known as 298 and 304 Kennedy Street West, from "Detached Dwelling First Density Residential (R1-13) Exception Zone" and "Detached Dwelling First Density Residential (R1-18) Exception Zone" to "Detached Dwelling First Density Residential (R1-20) Exception Zone", "Detached Dwelling Second Density Residential (R2) Zone" and "Detached Dwelling Second Density Residential (R2-62) Exception Zone". The purpose of the amendment is to fulfil conditions as laid down by the Committee of Adjustment. With respect to the R1-20 zone, the By-law provides for a decrease in the required minimum lot frontage (from 30.0 m or 98.4 ft to 9.35 m or 30.7 ft), setback limitations in order to limit development beyond the building envelope of the existing house and reductions in the required minimum interior side yard and maximum building height for an existing accessory building. Exceptions to the R2-62 zone include an increase in the minimum lot frontage from 15.0 m (49.2 ft) to 16.0 m (52.5 ft) and maximum lot coverage for a one storey dwelling unit from 3 5 percent to 40 percent in addition to decrease in the maximum permitted height for the main building from 10 m (32.6 ft) to 8.0 m (26.2 ft). 7. I also certify that the 20 day objection period expired on 8th day of August, 1995, and to this date no notice of objection to the By-law has been filed by any person in the office of the Clerk.
