BYLAW - Amend 2213 78 (Armadale, McAlpine) - 19950726 - 365295DArmadale/McAlpine THE CORPORATION OF THE TOWN OF AURORA By-law Number 3652-95.D BEING A BY-LAW to amend By-law No. 2213-78 WHEREAS it is deemed advisable to amend By-law number 2213-78. NOW THEREFORE the Council of the Corporation of the Town of Aurora enacts as follows: I) That the zoning category applying to the lands shown in shading on Schedule "A" attached hereto and forming part of this By-law is hereby amended from "Environmental Protection (E.P.) Zone" and "Service Conunercial (C3-3) Exception Zone (Urban)" to "Environmental Protection (E.P .) Zone" and "Service Conunercial (CJ-9) Exception Zone (Urban)". 2) That Section 22.4.2 is hereby amended by deleting the contents of that section and replacing them with the following: 22.4.2.1 22.4.2.2 22.4.2.2.1 22.4.2.2.2 22.4.2.2.3 22.4.2.3 Uses Permitted A maximum of two automotive sales dealerships including servicing areas and related accessory uses. Zone Requirements Lot Specifications Lot Area (minimum) Lot Frontage (minimum) 26 000 square metres 180 metres For the purposes of the C3-3 Zone, the Front Lot line shall be the lot line abutting Y onge Street or a reserve abutting Y onge Street. Siting Specifications Front Yard (minimum) Rear Yard (minimum) Interior Side Yard (minimum) -from the northern property line -from the southern property line Building Specifications In accordance with Section 22.2.3. Parking Requirements 45 metres 15 metres 12 metres 13 metres Notwithstanding the provisions of6.26.1, the minimum parking requirement shall be: Visitor and Employee Vehicle Display I 140 spaces 360 spaces 22.4.2.4 Notwithstanding the provisions of 6.26, the minimum required manoeuvring space for Vehicle Display spaces shall be nil. All other provisions of Section 6.26 shall apply. Landscaping Requirements The Owner shall provide a landscaped open space area containing such berms, walls, fences, hedges, trees, and shrubs or other such ground cover as are deemed necessary which will have the following dimensions: (a) Adjacent to Yonge Street-average 5 metres and in no case less than 2 metres. (b) Adjacent to Old Yonge Street -no less than 5 metres. 3) That Section 22 is hereby amended by adding the following as Section 22.9, "Service Commercial (C3-9) Exception Zone (Urban)": 22.9.1 22.9.2 22.9.2.1 22.9.2.2 22.9.2.3 22.9.3 Uses Permitted A maximum of two automotive sales dealerships Including servicing areas and related accessory uses. All other provisions of Section 6.26 shall apply. SCHEDULE "A" TO BY-LAW NO. 3652-95.0 000262 Explanatory Note Re: Zoning By-law 3652-95.D By-law 3652-95.D has the following purpose and effect: To amend By-law 2213-78, the Zoning By-law in effect in the Town of Aurora in order to facilitate a severance of the lands into two parcels. The subject lands form Part of Lot 84, Concession I E.Y.S. and are municipally known as 15783 to 15821 Yonge Street (Aurora Automotive Campus). Provisions of the C3-3 zone, which shall continue to apply to the southern portion of the lands, have been modified to reflect changes associated with the severance that include modified lot and parking specifications. The northern portion is rezoned to "Service Commercial (C3-9) Exception Zone (Urban)" with specific lot and siting specifications and parking requirements to permit a proposed expansion to the current buildings on the lands. The "Environmental Protection (E.P.) Zone" applying to the floodplain lands adjacent to Yonge Street remain unchanged. 7.
