BEING A BY-LAW to adopt Official Plan Amendment No. 12
The Council of the Corporation of the Town of Aurora, under Section 17 (6) of the Planning Act,
RSO 1990 Chapter P. 13 as amended, hereby enacts as follows:
1. Official Plan Amendment No. 12 for the Town of Aurora, consisting of the attached
explanatory text and schedules, is hereby adopted.
2. The Clerk is hereby authorized and directed to make application to the Minister of
Municipal Affairs for approval of Official Plan Amendment No. 12 for the Town of
Aurora.
3. This By-law shall come into force and take effect on the day of the final passage thereof.

THE AMENDMENT, consisting of the following text constitutes
Amendment No. 12 to the Official Plan for the Town of Aurora.

PART I -THE PREAMBLE
Purpose of the Amendment
The purpose of this amendment is to incorporate within the Private Open Space designation site
specific policies for the lands as identified below to permit the development of the property for
a semi -detached dwelling unit.
Location
The subject lands affected by this amendment are located at 35 & 37 Tyler Street. The legal
description is as follows: Part of Lots 24 and 25, Registered Plan 9.
Basis of the Amendment
Council has enacted the amendment on the following basis:
I. The Official Plan for the Town of Aurora is currently vague respecting the criteria for
construction of residential buildings within the floodplain. The municipality's long term
intention is to redefine the policies in concert with the Lake Simcoe Region Conservation
Authority and the Ministry of Natural Resources.
2. In ·response to a development application submitted to the muniCipality to replace an
existing structure on the subject lands with a semi-detached dwelling unit in accordance
with the provisions of the Lake Simcoe Region Conservation Authority, the municipality
has drafted this Amendment in order to not delay the proponent from awaiting the
municipal wide amendment as noted above.

All of this part of the document entitled Part II -The Amendment, consisting of the following
text, constitutes Amendment No. 12 to the Official Plan for the Town of Aurora.
Details of the Amendment
The Official Plan of the Town of Aurora is hereby amended as follows:
Item (1): Section 3.5.4 (Site Specific Policy Areas) is hereby amended by adding 3.5.4.b to
the end of the section as follows:
The following policies apply to the lands designated "Private Open Space" on Part of Lots 24
and 25, Registered Plan 9, known municipally as 35 & 37 Tyler Street.
b The lands designated as "Private Open Space" on Part of Lots 24 & 25, Registered Plan
9 shall only be used for a semi-detached dwelling unit. A site plan agreement shall
ensure that the design of the structure is sensitive to the surrounding environment and that
all objectives of the Lake Simcoe Region Conservation Authority and the Ministry of
Natural Resources can be achieved. In addition, a site investigation environmental impact
report shall be submitted in support of any redevelopment application as part of the site
plan approval process.
Implementation and Interpretation
The implementation and interpretation of this Amendment shall be in accordance with the
respective policies of the Aurora Official Plan, Zoning By-law, and Site Plan Agreements.

EXPLANATORY NOTE
RE: Official Plan Amendment Number 12
Official Plan Amendment No. 12 allows for the incorporation, within the Private Open Space
designation, site specific policies for the lands known as 35 & 37 Tyler Street, Part of Lots 24
& 25, Registered Plan 9 to permit the construction of a semi-detached dwelling unit. A site plan
agreement is required in order to ensure sensitivity to the surrounding environment is achieved
and that the objectives of the Lake Simcoe Region Conservation Authority and the Ministry of
Natural Resources can be met. In addition, a site investigation environmental impact report shall
be submitted in support of any redevelopment application as part of the site plan approval
process.
