BYLAW - Amend 2213 78 - 19950412 - 362195DTHE CORPORATION OF THE TOWN OF AURORA By-law Number 3621-95.D BEING A BY-LAW to amend By-law No. 2213-78 WHEREAS it is deemed advisable to amend By-law number 2213-78. Town of Aurora NOW THEREFORE the Council of the Corporation of the Town of Aurora enacts as follows: I) THAT the zoning category applying to the lands shown in dark outline on Schedule "A" attached hereto and forming part of this By-law is hereby amended from "Major Open Space (0) Zone" to "Major Open Space (0) Zone" and "Row Dwelling Residential Holding (H)R6-32 Exception Zone". 2) THAT Section IS is hereby amended by adding the following as Section 15.36 "Row Dwelling Residential Holding (H)R6-32 Exception Zone": 15.36.1 15.36.2 15.36.2.1 15.36.2.2 Uses Permitted row housing private home daycare Zone Requirements Lot Specifications Lot Area (minimum): Total Parcel Per Unit Lot Frontage (minimum) 0.8 hectares 270.0 square metres 20.0 metres Siting Specifications Minimum setback of the front of a building from any public street or private right of way Minimum setback of a garage from any public street or private right of way Minimum setback of an end or side wall from any public street or private right of way Minimum setback of an end or side wall from any lot line other than a street line Minimum setback of a rear wail from any lot line Minimum distance separation between the side of a building and the side· of another building 1 4.5 metres 6.0 metres 3.0 metres 1.5 metres 7.5 metres 3.0 metres ~!. Minimum distance separation between the front of a building and the front of another building 16.5 metres Minimum distance separation between the back of a building and the back of another building 15.0 metres Minimum distance separation between the back of a building and the side of another building 9.0 metres Minimum distance separation between the front of a building and the side of another building 15.0 metres Minimum distance separation between the front of a building and the back of another building 19.5 metres Minimum unobstructed distance between buildings on the same lot 3.0 metres Notwithstanding the above and the provisions of Section 6.48, balconies, steps, open roofed porches, uncovered terraces, patios and sundecks shall not be located closer then the required distance separation for the main building to any public street or private right of way with the exception that steps may encroach a maximum of 0.9 metres into the minimum required distance separation for an end or side wall. The minimum distance separation between balconies, steps, open roofed porches, uncovered terraces, patios and sundecks shall be 1.2 metres. On a comer lot where a daylighting triangle has been conveyed to a public authority, the minimum required setback from the day lighting triangle shall equal the required setback from the front or flankage lot line, whichever is the lesser requirement. 15.36.2.3 Building Specifications Floor Area: mrnunum 75.0 square metres maximum 175.0 square metres Lot coverage (maximum) 40.0% Height (maximum) 10.0 metres 15.36.3 PRIVATE OUTDOOR LIVING AREA Notwithstanding the provisions of Section 15.3.1.3, a screen wall and/or fence with a minimum height of 1.83 metres and a maximum height of 2 metres, shall be provided on either side of the private outdoor living area to a minimum depth of 3.6 metres. All other provisions of Section 15.3 shall apply. 15.36.4 GENERAL In accordance with Section 15.4 hereof. 15.36.5 HOLDING PREFIX Notwithstanding the provisions of Section 15.36 above, while the "(H)" Holding 2 prefix is in place, no person shall within the lands zoned (H)R6-32 on Schedule "A" attached hereto, use any lot or erect, alter or use any buildings or structures for any purposes except those uses which existed on the date of passing of this by-law. Furthermore, no extension or enlargement of the uses which existed on the date of passing of this by-law shall occur, unless an amendment to this by-law is approved by the Council of the Corporation of the Town of Aurora and comes into full force and effect. Removal of Holding Prefix Prior to the passing of a by-law to remove the "(H)" Holding prefix from the lands zoned (H)R6-32 or any part thereof, the Town of Aurora shall be satisfied that a site plan agreement has been executed between the owner of the lands and the Corporation of the Town of Aurora. Upon removal of the "(H)" Holding prefix from the lands zoned (H)R6-32 pursuant to Section 36 of the Planning Act, RSO 1990, or a successor thereto, the provisions applicable to the said lands shall be as set out in Section 15.36.1, 15.36.2, 15.36.3 and 15.36.4. 3) No part of this By-law will come into force until the provisions of the Planning Act have been complied with, but subject to such provisions the By-law will take effect from the day of passing thereof. Explanato_ry Note Re: Zoning By-law 3621-95.0 By-law 3621-95.0 has the following purpose and effect: To amend By-law 2213-78, the Zoning By-law in effect in the Town of Aurora, to rezone the subject lands, being Part Lot SO Concession 1 E.Y.S., more particularly described as Part 4 and Part of Part 3 Plan 65R-6842, located to south of Wellington Street East and to the west of the Ontario Hydro Corridor, from "Major Open Space (0) Zone" to "Major Open Space (0) Zone" and "Row Dwelling Residential Holding (H)R6-32 Exception Zone". The amendment is to permit the development of the tableland portion of the site for medium density rowhouses. The (H) prefix applied to the R6-32 zone must be removed prior to development requiring public notice but not further opportunity for appeal. The By-law provides that the (H) prefix not be removed until a Site Plan Agreement has been executed; prior to the removal of the (H) symbol the use of the lands is restricted to those uses existing on the date of passage of the.
