BY-LAW NUMBER 3566-94.D OF THE CORPORATION OF THE TOWN OF AURORA BEING A BY-LAW to amend By-law No. 2213-78 WHEREAS it is deemed advisable to amend By-law number 2213-78. NOW THEREFORE the Council of the Corporation of the Town of Aurora enacts as follows: 1. That the zoning category applying to the lands shown in shading on Schedule "A" attached hereto and forming part of this By-law is hereby amended from "Restricted Industrial Service (M1-1) Exception Zone" to "Service Commercial (C3-7) Exception Zone". 2. That the following be added as Section 22.8 "Service Commercial (C3-7) Exception Zone": 22.8.1 22.8.1.1 ~!. Uses Permitted banks and financial institutions dental and medical laboratories personal service shops business and professional offices clinics convenience retail stores dry cleaner's distribution depots retail uses accessory to permitted uses restaurants, drive-thru restaurnats and take-out restaurants, provided that the combined floor area of all restaurants and medical clinics does not exceed 370 square metres in Building 'A' and 20 percent of the total floor area of Building 'B', as shown on Schedule '0' attached hereto and forming part of this By-law. drug stores provided that the total combined floor area of all drug stores does not exceed 465 square metres. automotive rental establishments, automotive service centres, and automotive service stations with the exception that the storage and sale of gasoline or propane shall not be permitted, and provided that the uses irre resticted to the two easternmost ground floor units and that the combined floor area of all automotive uses does not exceed 785 square metres. Notwithstanding any provisions to the contrary, the following definitions shall apply to the C3-7 zone: Restaurant, Take-out means a building or part thereof where food is prepared and served to the public for consumption off the premises and which may contain incidental seating areas for consumption within the building but shall not include a 'Drive-Thru Restaurant'. Restaurant, Drive-Thru means a building or part thereof where food is prepared and served to the public while in motor vehicles by means of an order or window service which vehicles approach in designated lanes. 22.8.2 22.8.2.1 Zone Requirements In accordance with Section 22.2 with the exception that the minimum front yard setback for the main building shall be 9.0 metres. 3. No part of this By-law will come into force until the provisions of the Planning Act have been complied with, but subject to such provisions the By-law will take effect from the day of passing thereof. Zonin_$ By-law Number 3566-94.D By-law has the following purpose and effect: To amend By-law 2213-78, the Zoning By-law in effect in the Town of Aurora, to rezone the subject lands, being Part of Lots 22, 23,24 and 25 Plan M-51, municipally known as 2-8 Allaura Boulevard from "Restricted Industrial Service (Ml-1) Exception Zone" to "Service Commercial (C3-7) Exception Zone". The amendment changes the uses permitted on the lands to include: banks and financial institutions; dental and medical laboratories; personal service shops; business and professional offices; clinics; convenience retail stores; dry cleaner's distribution depots; restaurants, drive-thru restaurnats and take-out restaurants subject to specific definitions and floor area restrictions; drug stores subject to specific floor area restrictions; automotive rental establishments, automotive service centres, and automotive service stations excluding the storage and sale of gasoline or propane and subject to specific floor area and location restrictions; and, accessory retail uses.
