BEING A BY-LAW to amend By-Law 2213-78
WHEREAS it is deemed advisable to amend By-Law Number 2213-78,
NOW THEREFORE the Council of the Corporation of the Town of Aurora enacts as follows:
1) THAT the zoning category applying to the lands shown in dark outline on Schedule "A"
attached hereto and forming part of this By-law is hereby amended from "Rural General
(RU) Zone" to "Detached Dwelling Second Density Residential (R2-39) Exception Zone",
"Detached Dwelling Second Density Residential (R2-40) Exception Zone", "Detached
Dwelling Second Density Residential (R2-41) Exception Zone", "Detached Dwelling
Second Density Residential (R2-42) Exception Zone", "Semi-Detached and Duplex
Dwelling Third Density Residential (R3-1) Exception Zone", "Semi-Detached and Duplex
Dwelling Third Density Residential (R3-2) Exception Zone", "Row Dwelling Residential

2) THAT Section 11 is hereby amended by adding the following as Section 11.41 "Detached

13) No part of this By-law will come into force until the provisions of the Planning Act have
been complied with, but subject to such provisions the By-law will take effect from the
day of passing thereof.

To amend By-law 2213-78, the Zoning By-law in effect in the Town of Aurora to re-zone the
subject lands, being Part Lots 78 and 79 Concession 1 E.Y.S., from "Rural General (RU) Zone"
to "Detached Dwelling Second Density Residential (R2-39) Exception Zone", "Detached Dwelling
Second Density Residential (R2-40) Exception Zone", "Detached Dwelling Second Density
Residential (R2-41) Exception Zone", "Detached Dwelling Second Density Residential (R2-42)
Exception Zone", "Semi-Detached and Duplex Dwelling Third Density Residential (R3-1)

The Jot, siting and building specifications for the standard and new R2, R3 and R6 zones are set
out on the attached pages. The By-law also sets out specific siting provisions for balconies and
decks and exempts the street townhouse blocks from the general requirement that visitors parking
be set aside and visually identified.
The Holding (H) zone symbol applied to the block townhouses (HR6-13, HR-14 and HR-15),
must be removed prior to development, requiring further public notice but not a public meeting.

We are the solicitors for Cat Tail Investments
Inc. ("Cat Tail"), the owner of approximately 59.2 hectares
of land located in Part of Lots 78 and 79, Concession 1,
E.Y.S., in the Town of Aurora. On November 15, 1992, we
submitted a letter to the Ontario Municipal Board appealing
from the Town of Aurora's failure to deal with the Cat Tail
application for rezoning. We now understand that Aurora
Council will be considering a zoning by-law for the cat
Tail lands at its meeting scheduled for March 10, 1993.
For that reason, we hereby withdraw the above appeal of the
Town's failure to deal with the rezoning application.

I, Lawrence Allison, hereby certify that the notice for By-law #3424-93 of the Corporation of
the Town of Aurora, passed by the Council of the Corporation on the lOth day of March, 1993,
was given on the 11th day of March, 1993, in the manner and form and to the persons
prescribed by Ontario Regulation 404/83, as amended, made by the Lieutenant Governor-in-
Council under subsection 18 of section 34 of The Planning Act (1990). I also certify that the
20 day objection period expired on 31st day of March, 1993, and to this date no notice of
objection to the By-law has been filed by any person in the office of the Clerk.
The provisions of this By-law will take effect upon the receipt of ministerial approval of Town
of Aurora Official Plan Amendment #61.
