I, Gordon Whicher, hereby certify that the notice for By-law #3474-93 of the Corporation of the
Town of Aurora, passed by the Council of the Corporation on the 23rd day of June, 1993, was
given on the 29th day of June, 1993, in the manner and form and to the persons prescribed by
Ontario Regulation 404/83, as amended, made by the Lieutenant Governor-in-Council under
subsection 18 of section 34 of The Planning Act (1990). I also certify that the 20 day objection
period expired on 19th day of July, 1993, and to this date no notice of objection to the By-law
has been filed by any person in the office of the Clerk.

BY-LAW NUMBER 3474-93
OF THE CORPORATION OF THE TOWN OF AURORA
BEING A BY-LAW to amend By-law No. 2213-78
WHEREAS it is deemed advisable to amend By-law number 2213-78.
NOW THEREFORE the Council of the Corporation of the Town of Aurora enacts as
follows:
1. That Section 3.72 is hereby amended by deleting the contents of the section and
replacing them with the following:
"3.72 Lot Coverage:
means that proportion of the lot area covered by all buildings including accessory
buildings which are above ground level and open-sided roofed porches, however
excluding decks attached to the main building, uncovered terraces, patios, balconies,
landings and steps."
2. That Section 3 is hereby amended by adding the following as subsection 3.161:
"Balcony:
means a raised platform or structure in excess of 3.0 metres above grade projecting
immediately from the main building."
3. That the encroachment provisions set out in Section 6.48.1 for open-sided roofed
porches, uncovered terraces, pati,tSs, and decks, and for balconies and steps, are hereby
deleted and replaced,with the ~6llowing:

Unless specified elsewhere in the By-law, the above encroachments for open-sided
roofed porches, patios, uncovered terraces, decks and balconies shall be subject to a
minimum distance separation of 4.5 metres from the front lot line, 3.8 metres from a
rear lot line, 3 metres from an exterior side lot line, 0.6 metres from an interior side
lot line or a common lot line between attached dwelling units. Notwithstanding the
above and any provisions to the contrary, in the R6 zone, a deck, open-sided roofed
porch or balcony exceeding I metre in height, shall be setback a minimum of 1.2
metres from the interior side lot line or common lot line between attached dwelling
units. The above encroachment for steps shall be subject to a minimum distance
separation of 4.5 metres from the front lot line, 0.3 metres from an interior side lot
line and 2.1 metres from an exterior side lot line. On a lot or block with more than
one dwelling unit, the minimum distance separation between balconies, steps, open-
sided roofed porches, uncovered terraces, patios and decks shall be 1.2 metres. Where
a deck or balcony is located closer than 1.2 metres to a side lot line, a privacy screen
with a minimum height of 1.5 metres shall be required along the full extent of the
deck or balcony abutting that lot line."
4. That Sections 11.41.2.2, 11.42.2.2, 11.43.2.2, 11.44.2.2, 12.3.2.2, and 12.4.2.2 are
hereby amended by deleting the last paragraph of the section beginning with the words
"Notwithstanding the above and the provisions of Section 6.48 ... "
5. That Section 6.21.12 is hereby amended by adding the words "however shall not
include the consulting room of a medical or drugless practitioner" to the end of the
section.
6. That Section 6.26.1 is hereby amended by adding the following as Section 6.26.1.20:
"6.26.1.20 Golf Courses 24 parking spaces for each 9 holes of
the golf course in addition to the
requirements for any other use or facility
provided."
7. That Section 6.31 is hereby amended by adding the following as Section 6.31.3:
"6.31.3 The provisions of Section 6.31.1 and 6.31.2 shall not apply to public and
private schools, as defined in the by-law. Where such schools are adjacent
to any Residential Zone, Holding Zone or residential use, the minimum
buffer strip requirements shall include either a solid wood or chain link
fence with minimum height of 1.5 metres in conjunction with a landscaping
strip having a minimum width of 1.5 metres."

8. That the zoning category applying to the lands shown in shading on Schedule "A"
attached hereto and forming part of this By-law, being Lots 69-72 inclusive,
Registered Plan 514 and Lots 71 and 275, Registered Plan 475 is hereby amended
from "Detached Dwelling Second Density Residential (R2) Zone" to "Semi-Detached
and Duplex Dwelling Third Density Residential (R3) Zone".
9. That the zoning category applying to the lands shown in shading on Schedule "A"
attached hereto and forming part of this By-law, being Lot 327, Plan 514 and Lots 41,
69 and 72, Registered Plan 475 is hereby amended from "Semi-detached and Duplex
Dwelling Third Density Residential (R3) Zone" to "Detached Dwelling Second Density
Residential (R2) Zone".
10. That the zoning category applying to the lands shown in shading on Schedule "A"
attached hereto and forming part of this By-law, being Lot 63, Registered Plan M-64
is hereby amended from "Semi-detached and Duplex Dwelling Third Density
Residential (R3) Zone" to "Detached Dwelling Second Density Residential (R2-43)
Exception Zone".
11. That Section 11 is hereby amended by adding the following as Section 11.45
"Detached Dwelling Second Density Residential (R2-43) Exception Zone":
"Notwithstanding the provisions of Section 11.2.1, the minimum lot area shall be 420
square metres. All other provisions of Section 11.1 and 11.2 shall apply."
12. That the zoning category applying to the lands shown in shading on Schedule "A"
attached hereto and forming part of this By-law being Lots 46, 63, 69, 73, 103, 108,
125, 138, 144 and 150, Registered Plan M-57 is hereby amended from "Detached
Dwelling Second Density Residential (R2) Zone" to "Detached Dwelling Second
Density Residential (R2-37) Exception Zone".
13. That the zoning category applying to the lands shown in shading on Schedule "A"
attached hereto and forming part of this By-law being Lots 197, 200, 201 and 204,
Registered Plan M-57 and Lots 8 to 12 inclusive, 15 to 19 inclusive, 23, 24 and 26
to 29 inclusive, Registered Plan M-87 is hereby amended from "Semi-Detached and
Duplex Dwelling Third Density (R3) Zone" to "Semi-Detached and Duplex Dwelling
Third Density Residential (R3-3) Exception Zone".
14. That Section 12 is hereby amended by adding the following as Section 12.5 "Semi-
Detached and Duplex Dwelling Third Density Residential (R3-3) Exception Zone":
"Notwithstanding the provisions of Section 12.2.2 respecting interior side yards, the
minimum interior side yard for the lands shown zoned R3-3 shall be 1.2 metres for
either a one or a two storey building. All other provisions of Sections 12.1 and 12.2
shall apply."
15. That the zoning category applying to the lands shown in shading on Schedule "A"
attached hereto and forming part of this By-law, being Lots 1 to 32 inclusive and Lots
50 to 59, inclusive, Registered Plan M-64 is hereby amended from "Row Dwelling
Residential (R6) Zone" to "Row Dwelling Residential (R6-16) Exception Zone".
16. That Section 15 is hereby amended by adding the following as Section 15.20 "Row
Dwelling Residential (R6-16) Exception Zone":

· "Notwithstanding the provisions of Section 15.2.3, the maximum lot coverage for the
lands shown zoned R6-13 shall be 35 percent. All other provisions of Sections 15.2,
15.3 and 15.4 shall apply."
17. That Section 28.3.2 is hereby amended by changing the reference from "I-1" to "I-2".
18. That the zoning category applying to the lands shown in shading on Schedule "A"
attached hereto and forming part of the By-law is hereby amended from "Institutional
(I-1) Exception Zone" to "Institutional (I-2) Exception Zone".
19. No part of this By-law will come into force until the provisions of the Planning Act
have been complied with, but subject to such provisions the By-law will take effect
from the day of passing thereof.

Explanatory Note
Re: Zoning By-law
By-law3t71~s the following purpose and effect:
To amend By-law 2213-78 the Zoning By-law in effect in the Town of Aurora to:
1. Revise the provisions related to decks, balconies and similar structures, including
regulations pertaining to encroachments, setbacks, coverage and screening requirements;
2. Clarify that consulting rooms of a medical or drugless practitioner are not permitted as
a home occupation;
3. Establish a parking standard for golf courses;
4. Revise the buffer strip requirements for schools;
5. Rezone specific lots on Batson and Walton Drive, Avondale and Odin Crescent, and
Spruce Street, to change the interior side yard requirement from 1.2 metres for a one
storey structure and 1.5 metres for a two storey, to 1.2 metres for either a one or two
storey to recognize the siting of existing dwellings;
6. Rezone specific lots on Tilston Grove, Murray and Richardson Drive; Sandusky, Kitimat
and Foreht Crescent; and Huron and Wiles Court, to correct previous drafting, textual or
typographical errors.
