AFFIDAVIT UNDER SECTION 34(22) OF THE PLANNING ACT (1990)
I, Lawrence Allison, hereby certify that the notice for By-law #3489-93 of the Corporation of
the Town of Aurora, passed by the Council of the Corporation on the 27th day of October,
1993, was given on the 9th day of November, 1993, in the manner and form and to the persons
prescribed by Ontario Regulation 404/83, as amended, made by the Lieutenant Governor-in-
Council under subsection 18 of section 34 of The Planning Act (1990). I also certify that the
20 day objection period expired on 29th day of November, 1993, and to this date no notice of
objection to the By-law has been filed by any person in the office of the Clerk.

BY-LAW NUMBER 3489-93
OF THE CORPORATION OF THE TOWN OF AURORA
BEING A BY-LAW to amend By-law No. 2213-78
WHEREAS it is deemed advisable to amend By-law number 2213-78.
NOW THEREFORE the Council of the Corporation of the Town of Aurora enacts as
follows:
1. That Section 3.23 is hereby amended by deleting the contents of the section and
replacing them with the following:
"3.23 Carport:
means a structure having a roof which has less than sixty ( 60) percent of the total
perimeter enclosed by walls, doors or windows, used for the temporary parking or
storage of private passenger motor vehicles or commercial motor vehicles in
accordance with Section 6.28, and wherein neither servicing nor repairing is carried
on for remuneration. For the purposes of this By-law, perimeter includes the main
wall of the building to which the carport is attached."
2. That Section 3.50 is hereby amended by deleting the contents of the section and
replacing them with the following:
"3.50 Garage, Private:
means a structure having a roof which has more than sixty (60) percent of the total
perimeter enclosed by walls, doors or windows used for the parking or storage of
private passenger vehicles or trucks or vans or commercial motor vehicles in
accordance with Section 6.28, and wherein neither servicing nor repairing is carried
on for remuneration."
3. That Section 3 is hereby amended by adding the following as subsection 3.162:
"3.162 Vehicle Weight, Gross:
means th~ weight of a vehicle plus a full load, as specified on the owner's vehicle
registration."
4. That Section 3.98 is hereby amended by deleting the contents of the section and
replacing them with the following:
"3.98 Parking Space:
means an area exclusive of driveway or aisles used for the temporary parking of one
(1) motor vehicle, and which has adequate access to permit ingress and egress of a
motor vehicle to and from the space by means of driveway, aisle, manoeuvring area
or similar area."
5. That Section 6.27 is hereby amended by deleting the contents of subsection 6.27.7 and
replacing them with the following:
"Off-Street Parking in Yards:
No part of any parking area other than a driveway shall be permitted in any front yard
in any Residential Zone. No off street parking other than visitors parking shall be
permitted in any front yard in any Restricted Industrial (M1) Zone. In all other zones
where parking is permitted in the front yard, the parking area shall be separated from
any adjacent street line by a strip of land not less than one decimal five (1.5) metres
in width, which shall be reserved for landscaping purposes and such strip shall be

bordered by a curb or similar barrier except for entrances and exits."
6. That Section 6.28 is hereby amended by deleting the contents of the section and
replacing them with the following:
"6.28 Parking Areas
Parking areas as defined in this By-law shall be used for no other purpose than for the
parking of operative passenger vehicles and vehicles used in operations incidental to
the permitted uses on the lot, all bearing currently valid motor vehicle licence plates.
A parking space as defined in this By-law shall be used for the temporary parking of
one (1) motor vehicle and no part of any driveway, aisle, manoeuvring area or similar
area which is provided to permit ingress and egress to such parking space shall be
used for the temporary parking or storage of one (1) or more motor vehicles."
6.28.1 Parking Areas in Residential Zones
In any residential zone, the parking or storage of any of the following vehicles shall
be prohibited unless the lot is being actively prepared for or undergoing construction
for which the vehicle/equipment is intended or the parking or storage is in accordance
with the provisions of Section 6.41:
-any vehicle with a gross vehicle weight rating that exceeds 3900 kilograms;
-any vehicle with an overall vehicle length that exceeds 6.0 metres;
-mobile construction equipment;
-farm tractors.
6.28.1.i Residential Parking Areas in Zones Requiring Less Than Five Spaces:
The maximum width of a driveway/parking spaces in any residential parking area
requiring less than five spaces shall be:
-3.5 metres if the lot frontage, or the exterior side lot line on a comer lot having
access from the flankage street, is less than 9 metres;
- 6 metres if the lot frontage, or the exterior side lot line on a comer lot having
access from the flankage street, is greater than or equal to 9 metres and less than
18 metres;
- 9 metres if the lot frontage, or the exterior side lot line on a comer lot having
access from the flankage street, is greater than or equal to 18 metres.
A maximum of one driveway shall be permitted. Notwithstanding the above, the
maximum width of the driveway at the street line shall be 6 metres. Circular
driveways shall only be permitted on lots or parcels having a frontage, or exterior side
lot line on a comer lot with access from the flankage street, of 25 metres or more.
Where a circular driveway is permitted, the maximum width of the driveway at the
street line shall not exceed 6 and 4 metres.
6.28.1.ii Residential Parking Areas in Zones Requiring Five or More Spaces:
In accordance with Section 6.27
7. That Section 7.7 "Parking For Commercial Motor Vehicles" is hereby deleted.
8. No part of this By-law will come into force until the provisions of the Planning Act
have been complied with, but subject to such provisions the By-law will take effect
from the day of passing thereof.

By-law " has the following purpose and effect:
To amend By-law 2213-78 the Zoning By-law in effect in the Town of Aurora to:
o replace existing provisions for residential zones which prohibit the parking or storage
of commercial motor vehicle in excess of one tonne capacity with restrictions on the
parking or storage of any vehicle with a gross vehicle weight rating of over 3900
kilograms or a length of over 6 metres, mobile construction equipment and farm
tractors;
o define gross vehicle weight;
o add provisions for driveways in residential zones requiring less than five spaces which:
limit the maximum number of driveways to one; permit circular driveways only if the
lot frontage or flankage lot line equals or exceeds 25 metres; and, restrict the width
of the driveway and parking spaces to a maximum of 3.5 metres if the frontage or
flankage lot line is less than 9 metres, 6 metres if greater than or equal to 9 and less
than 18 metres, and 9 metres if equal to or greater than 18 metres, subject to a
maximum width at the streetline of 6 metres, or of 6 and 4 metres for a circular
driveway.
