BYLAW - Project Hostel Encroachments - 19920624 - 340892BY-LAW NUMBER 3408-92 OF THE CORPORATION OF THE TOWN OF AURORA BEING A BY-LAW to permit certain encroachments on Victoria Street at 37 Wellington Street East ( The Yellow Brick House). WHEREAS the provisions of the Municipal Act R.S.O. 1990, c.M.45 (as amended, the "Act") authorize Council to enact a By-law to allow any person owning or occupying any building that, by inadvertence, has been wholly or partially erected upon any highway to maintain and use such building thereon; AND WHEREAS the Act authorizes Council to enact a By-law to lease or licence the use of untravelled portions of highways under its jurisdiction; NOW THEREFORE the Municipal Council of the Corporation of the Town of Aurora enacts as follows: 1. Project H.O.S.T.E.L. (The Yellow Brick House) and its successors in title to the following lands: Part of Homestead Lot, Plan 68, Town of Aurora, Regional Municipality of York, (Formerly in the Township to Whitchurch), as more particularly described in a plan of survey by A. Karklins Surveying Ltd., dated 15 December 1988. be and are hereby permitted to continue and maintain such aspects of the existing structure as have been erected by inadvertence upon the highway municipally known as Victoria Street, pursuant to the terms of the agreement between Project H.O.S.T.E.L. and the Town of Aurora dated July 29, 1992. 2. The Corporation of the Town of Aurora is hereby authorized to enter into a lease with Project H.O.S.T.E.L. (The Yellow Brick House) and its successors in title with respect to the untravelled portion of Victoria Street for certain aspects of the structures all as shown on Site Plan SP-90-02, pursuant to the terms of the agreement between Project H.O.S.T.E.L. and the Corporation of the Town of Aurora dated July 29, 1992. 3.
