BYLAW - OPA #62 - 19910925 - 332691(Kwik Kopy) ADOPTION BY-LAW FOR OFFICIAL PLAN AMENDMENT NO. 62 BY-LAW NUMBER 3326-91 OF THE MUNICIPAL CORPORATION OF THE TOWN OF AURORA The Council of the Corporation of the Town of Aurora, under Section 17 (6) of the Planning Act, 1983, hereby enacts as follows: 1. Official Plan Amendment No. 62 for the Town of Aurora, consisting of the attached explanatory text and schedule, is hereby adopted. 2. The Clerk is hereby authorized and directed to make application to the Minister of Municipal Affairs for approval of Official Plan Amendment No. 62 for the Town of Aurora. 3. This By-law shall come into force and take effect on the day of the fmal passage thereof. THE AMENDMENT, consisting of the following text and schedule, constitutes Amendment No. 62 to the Official Plan for the Town of Aurora. - 2 - PART I-THE PREAMBLE Purpose of the Amendment The purpose of this amendment is to change the land use designation on the subject lands shown on Schedule 'A' attached hereto and forming part of this amendment from "Urban Separator" and "Environmental Protection Area" to "Environmental Protection (Specific)" and to establish site specific policies to permit limited commercial use of the lands. Location The lands affected by this amendment are located in Part Lot 85, Concession 1 W.Y.S. Basis of the Amendment Council has enacted this amendment in response to the following: 1. The lands are located in an urbanizing area at the intersection of two arterial roads, Yonge Street and St. John's Sideroad. 2. The proposed business office use and ancillary management training is compatible with existing and proposed land uses in the vicinity and would secure the preservation and long term viability of the heritage structure. The continuation of the traditional equestrian use further complements heritage objectives. 3. The limited scale of the proposed building addition and parking would not significantly alter the open space character of the lands, thereby contributing to the municipal objective of providing a gateway at the northern entrance to the community. 4. A public trail is to be provided on the site to allow for the continuity and planned extension of the linear open space system. 5. The development is to be on full municipal services. Traffic on Y onge Street ( highway 11) will not be severely impacted as vehicular access to the site is to be by way of St. John's Sideroad only. 6. Although the majority of the site lies within the floodplain of Tannery Creek, including the site of the proposed office/training centre, measures shall be incorporated in the Site Plan Agreement to mitigate potential hazards and impacts on the natural environment. Site plan control shall also ensure the compatibility of the proposed building addition with the heritage structure and the protection of the privacy and amenity of adjacent low density residential lands. • 3. PART II. THE AMENDMENT Introductory Statement All of this part of the document entitled Part II -The Amendment, consisting of the following text and attached map, designated Schedule 'A' (Land Use Plan), constitutes Amendment No. 62 to the Official Plan for the Town of Aurora. Details of the Amendment The Official Plan of the Town of Aurora is hereby amended as follows: Item (1): Item (2): The area indicated on Schedule 'A' attached hereto and forming part of tltis amendment, being Part of Lot 85 Concession 1 W.Y.S., is hereby redesignated from "Urban Separator" and "Environmental Protection Area" to "Environmental Protection (Specific)". Section 4 (Land Use) Subsection 11 (Environmental Protection) is hereby amended by adding the following to the end of that section: The lands designated "Environmental Protection (Specific)" in Lot 85 Concession 1 W.Y.S., may be used for a business office with ancillary management training. The commercial boarding of horses shall be permitted as an ancillary use provided the number of horses does not exceed the capacity of the existing thirteen stalls. A single accessory dwelling unit shall be permitted to accommodate a caretaker associated with the equestrian operation. The following provisions shall apply to the subject lands: i) A building addition may be permitted provided it does not exceed 365 square metres of gross floor area and is compatible in design, massing, and exterior cladding with the existing heritage structure. The owners shall work with the Town to ensure the long term preservation of historically significant structures. ii) The lands shall be subject to a site plan agreement which , among other matters, shall give special attention to the implementation of effective measures to mitigate potential impacts of the building addition and parking facilities on the environment and warmwater fishery, both during and after construction. The site plan shall be circulated to, and subject to the approval of the Town, the Ministries of Natural Resources and Transportation, the Lake Simcoe Region Conservation Authority, and the • 4 . York Region Officer of Medical Health. Storrnwater management plans and grading plans showing the limits of disturbance to the area around the parking areas and the building addition, shall be submitted in conjunction with the proposed site plan and approved prior to commencement of any construction on the lands. The Site Plan Agreement shall incorporate erosion and sedimentation control measures including the provision of a naturally vegetated buffer strip along the streambanks of Tannery Creek to the satisfaction of the Ministry of Natural Resources. iii) As the majority of the lands lie within the floodplain of Tannery Creek, the Site Plan Agreement shall recognize the hazard of potential flooding and include provisions to ensure floodproofing of any building addition and restrictions on overnight use of parking facilities, subject to the approval of the Town and the Lake Simcoe Region Conservation Authority. iv) The site plan agreement shall require the provision of, and public access to a pedestrian/biking trail across the lands to ensure the extension and continuity of the linear open space system. The applicants shall work with the Town in consultation with external agencies to determine the optimal location and design of the pathway prior to the issuance of building permits. v) The site plan agreement may also require the provision of additional landscaping to screen the building and parking areas to ensure an attractive northern entrance to the Town and the privacy and amenity of adjacent residential lands. vi) The development shall be on the basis of full municipal water and sanitary services. vii) Vehicular access to the lands will be from St. John's Sideroad only at a location suitable to the Town of Aurora, the Ministries of Transportation and Natural Resources, and the Lake Simcoe Region Conservation Authority. viii) It shall be the policy of this Plan to zone the lands in an appropriate environmental protection category with specific exception provisions to ensure implementation in accordance with the policies of this Plan. Implementation and Interpretation The implementation and interpretation of this Amendment shall be in accordance with the respective policies of the Aurora Official Plan. Page 3, PART II -THE AMENDMENT, Details of the Amendment, Item (2), Section ii) is hereby modified to insert the words "fifteen metre" between " ... the provision of a" and "naturally vegetated buffer strip ...
