BYLAW - ZBA Pandolfo - 20140812 - 565714THE CORPORATION OF THE TOWN OF AURORA By-law Number 5657-14 BEING A BY-LAW to amend Zoning By-law Number 2213-78, as amended (Pandolfo). WHEREAS section 34 of the Planning Act, R.S.O. 1990, c. P.13, as amended, provides that the councils of local municipalities may pass zoning by-laws; AND WHEREAS the Council of The Corporation of the Town of Aurora (the "Town") enacted By-law Number 2213-78, including amendments thereto (the "Zoning By- law"); AND WHEREAS the Council of the Town deems it necessary and expedient to further amend the Zoning By-law; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF AURORA ENACTS AS FOLLOWS: 1. THAT the Zoning By-law be and is hereby amended to replace the "Oak Ridges Moraine Rural (RU-ORM) Zone" zoning category applying to the lands shown in hatching on Schedule "A" attached hereto and forming part of this By-law with "Detached Dwelling Second Density Residential (R2-101) Exception Zone", "Detached Dwelling Second Density Residential (R2-102) Exception Zone", "Detached Dwelling First Density Residential (R1-46) Exception Zone", "Major Open Space (0) Zone", and "Oak Ridges Moraine Environmental Protection (EP-ORM) Zone". 2. THAT the Zoning By-law be and is hereby amended to add the following: "SECTION 11.103 DETACHED DWELLING SECOND DENSITY RESIDENTIAL (R2-101) EXCEPTION ZONE 11.103.1 Uses Permitted one (1) detached dwelling per lot a home occupation 11.103.2 Zone Requirements 11.103.2.1 Lot specifications (minimum) Lot Area Lot Frontage 11.103.2.2 Siting Specifications (minimum) Front Yard Rear Yard Interior Side Yard Exterior Side Yard 11,103.2.3 Building Specifications Floor Area (minimum): one (1) storey two (2) storey Lot Coverage (maximum) Height (maximum) 460.0 square metres 15.0 metres 6.0 metres 7.5 metres 1.2 metres 4.5 metres 120.0 square metres 130.0 square metres 35.0 percent 10.0 metres By-law Number 5657-14 Page 2 of 5 3. 11.103.2.4 Parking Notwithstanding the definition contained within Section 3.98 and the provisions of Section 6.26.1.1, a minimum of three (3) parking spaces shall be provided, of which a minimum of one (1) parking space shall be provided within a private garage, and a minimum of two (2) parking spaces shall be provided, either in tandem or side by side, on the driveway. 11.103.2.5 Landscaping Specifications Notwithstanding any other provisions to the contrary, a minimum of 40 percent of the lot area shall be preserved in an open, landscaped or natural condition. This 40 percent shall not include a swimming pool, accessory buildings or structures, paved driveway, patio or any area covered with impervious material." THAT this By-law shall come into full force subject to compliance with the provisions of the Planning Act, R.S.O. 1990, c. The rezoning will permit the development of twenty-nine (29) residential single detached dwelling units.
