ADOPTION BY-LAW FOR OFFICIAL PLAN AMENDMENT NO. 59
BY-LAW NUMBER 3278-91
OF THE MUNICIPAL CORPORATION OF THE TOWN OF AURORA
The Council of the Corporation of the Town of Aurora, under Section 17 (6) of the Planning Act,
1983, hereby enacts as follows:
1. Official Plan Amendment No. 59 for the Town of Aurora, consisting of the attached
explanatory text, is hereby adopted.
2. The Clerk is hereby authorized and directed to make application to the Minister of
Municipal Mfairs for approval of Official Plan Amendment No. 59 for the Town of
Aurora.
3. This By-law shall come into force and take effect on the day of the fmal passage thereof.

THE PREAMBLE does not constitute part of this Amendment.
THE AMENDMENT, consisting of the following text constitutes
Amendment No. 59 to the Official Plan for the Town of Aurora.

PART I · THE PREAMBLE
Purpose of the Amendment
The purpose of this amendment is to change the existing policies applying to the subject lands
designated "Commercial" to permit second floor residential apartment uses above the commercial
uses on these lands.
Location
The lands affected by this amendment comprise Block 9, Registered Plan 65M-2298 and Part of
Lot 90, Plan 246, municipally known as 151, 157 and 159 Yonge Street North.
Basis of the Amendment
Council has enacted this amendment in response to the following:
1. The proposed amendment will allow a building currently under construction originally
intended through O.P.A. #55 to be used for office space above commercial uses to be
used for residential apartments, improving the economic viability of the development on
these lands and providing additional rental housing stock within the Town.
2. The residential units proposed at this location will take advantage of the commercial
facilities and the transit network along Y onge Street and will be compatible with adjacent
low density residential uses to the east given the low rise scale of the development.
3. The building is visually attractive and its design is appropriate for residential units above
the commercial uses.
4. There is sufficient parking on site to accommodate the proposed residential uses.

PART ll-THE AMENDMENT
Introductory Statement
All of this part of the document entitled PART ll -The Amendment, consisting of the following
text constitutes No. 59 to the Official Plan for the Town of Aurora.
Details of the Amendment
The Official Plan of the Town of Aurora is hereby amended as follows:
Item (1): Section 4 (Land Use) Subsection 5 (Commercial) is amended with respect to the
policies applying to Block 9, Registered Plan 65M-2298 and Part of Lot 90, Plan
246 by adding the following after the last paragraph of that section:
"4. A maximum of six residential units shall be permitted
above the commercial uses on the second floor of the two
storey building on these lands. An amendment to the Site
Plan Agreement shall ensure provision on site for
designated parking spaces for both residents and visitors of
such dwelling units".
Implementation and Interpretation
The implementation and interpretation of this Amendment shall be in accordance. with the
respective policies of the Aurora Official Plan, Zoning By-law and Site Plan Agreements .
