OF THE CORPORATION OF THE TOWN OF AURORA
BEING A BY-LAW to approve a
Transfer of Easement by the
Corporation of the Town of Aurora
to Bell Canada.
WHEREAS by virtue of an Agreement entered into by The Corporation of the
Town of Aurora, as Transferor, and Bell Canada, as Transferee, pursuant to
Section 193(1) of The Municipal Act, R.S.O. 1980, Chapter 302, as amended,
the Corporation of the Town of Aurora has agreed to convey Part of Block
129, Plan 65M-2461, Designated as Part 1, Plan 65R-14249, Town 'of Aurora,
Regional Municipality of York (hereinafter called the "Lands");
AND WHEREAS in consideration of the aforesaid reconveyance Bell Canada has
agreed to pay to the Corporation of the Town of Aurora the purchase price of
FIVE THOUSAND ($5,000.00) DOLLARS.
NOW THEREFORE the Council of the Corporation of the Town of Aurora enacts
as follows:
1. That the Lands are no longer required by the Corporation of the Town of
Aurora for Municipal purposes;
2. That the Lands be transferred to Bell Canada for the consideration of
Five Thousand ($5,000.00);
3. The Town So 1 i citor is hereby authorized to cause a copy of this By-1 aw
to be registered against the Lands in the proper registry office;
4. The Town Clerk and the Mayor are hereby authorized to sign and execute
under seal of the Corporation of the Town of Aurora all documentation
necessary to effect the disposition of the Lands to Bell Canada.

SUBJECT: BELL CANADA EASEMENT --Henderson Drive
1. RECOMMENDATIONS/CONCLUSIONS:
That the request for a Bell Canada Easement on Henderson Drive and
subsequent landscaping provided by Bell Canada be approved, and that
payment of $5,000.00 for the easement be placed in the Parks Reserve
Account.
2. BASIC DATA PERTAINING TO THE MATTER:
Bell canada approached the Town of Aurora seeking approval to place
Bell switching equipment in Tamarac Green Park within the Iona
Subdivision, to address increased need in the neighbourhood and the
subdivision south. Due to the tight constraints at the south area of
the park, an alternative was suggested by Bell to place the switching
equipment on the Henderson Drive right-of-way at the extreme north-east
corner of the case Woodlot.
There is a hydro transformer on a private lot immediately to the east
and Bell canada indicates that the location is optimum for access to
other trunk lines required for this installation. The letter attached
indicates suitable landscaping will be placed and a payment of
$5,000.00 for the easement and all legal costs to be paid by Bell
canada.
