BYLAW - ZBA 118 Wellington St E - 20140909 - 565214THE CORPORATION OF THE TOWN OF AURORA By-law Number 5652 -14 BEING A BY-LAW to amend Zoning By-law Number 2213-78, as amended (118 Wellington Street East). WHEREAS section 34 of the Planning Act, R.S.O. 1990, c. P.13, as amended, provides that the councils of local municipalities may pass zoning by-laws; AND WHEREAS the Council of The Corporation of the Town of Aurora (the 'Town") enacted By-law Number 2213-78, including amendments thereto (the "Zoning By- law"); AND WHEREAS the Council of the Town deems it necessary and expedient to further amend the Zoning By-law; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF AURORA HEREBY ENACTS AS FOLLOWS: 1. THAT the Zoning By-law be and is hereby amended to replace the "Special Mixed Density Residential (R5) Zone" zoning category applying to the lands shown in hatching on Schedule "A" attached hereto and forming part of this By-law with "Special Mixed Density Residential (R5-40) Exception Zone". 2. THAT the Zoning By-law be and is hereby amended to add the following: "14.3.40 SPECIAL MIXED DENSITY RESIDENTIAL (R5-40) EXCEPTION ZONE 14.3.40.1 Uses Permitted In addition to the uses permitted in Section 14.1, the lands zoned R5-40 may also be used for: - business and professional offices - personal service shops - retail stores - restaurants - studios - travel agencies - bake shops 14.3.40.2 Zone Requirements In accordance with Section 3.78.4, the front lot line shall be Wellington Street East. 14.3.40.2.1 Lot Specifications Lot Area (minimum) 500.0 square metres Lot Frontage (minimum) 9.0 metres 14.3.40.2.2 Siting Specifications Front Yard (minimum) 3.0 metres Rear Yard (minimum) 7.5 metres Western Interior Side Yard (minimum) 0.0 metres Eastern Interior Side Yard (minimum) 2.0 metres By-law Number 5652 -14 Page 2 of 3 14.3.40.2.3 Building Specifications In accordance with the provisions of Section 11.2.3 14.3.40.2.4 Buffer Strip Notwithstanding the provisions of Section 6.31, and any other provisions to the contrary, a minimum buffer strip of Nil shall be provided along the westerly lot line and a 1.5 metre high wooden privacy fence extending from the existing building to 5.0 metres from the North lot line shall be provided. 14.3.40.2.5 Parking Location 14.3.40.2.5.1 Notwithstanding the provisions of Section 6.26.1, and any other provisions to the contrary, non-residential development shall require a minimum of 2.0 spaces and a maximum of 3.0 spaces per 100 square metres of Gross Floor Area. 14.3.40.2.5.2 Notwithstanding the provisions of Section 6.26.1, and any other provisions to the contrary, residential development shall require a minimum of 1.0 and a maximum of 1.25 parking spaces per unit, inclusive of visitor parking. 14.3.40.2.5.3 The previsions of Sections 6.27.2 and 6.27.8 (f) shall not apply. 14.3.40.2.6 Yard and Setback Encroachments Notwithstanding the provisions of Section 6.48.1, the minimum distance separation for steps from the front lot line shall be 2.5 metres." 4. THAT this By-law shall come into full force subject to compliance with the provisions of the Planning Act, R.S.O. 1990, c. P. 13, as amended, and subject to compliance with such provisions, this By-law will take effect from the date of final passage hereof. READ A FIRST AND SECOND TIME THIS 9th DAY OF SEPTEMBER, 2014. The rezoning will permit business and professional office and personal service shop uses on the subject lands.
