BYLAW - OPA #55 - 19900328 - 317690-' AOOPI'ION BY-LAW FOR OFFICIAL PLAN AMENDMENT NO. 55 / BY-LAW NUMBER 3176-90 OF THE MUNICIPAL CORPORATION OF THE 'KmN OF AURORA 'Ihe Council of the Corporation of the Town of Aurora, under Section 17 (6) of the Planning Act, 1983, hereby enacts as follows: 1. Official Plan Amendment No. 55 for the Town of Aurora, consisting of the attached explanatory text, is hereby adopted. 2. 'Ihe Clerk is hereby authorized and directed to make application to the Minister of Municipal Affairs for approval of Official Plan Amendment No.55 for the 'Ibwn of Aurora. 3. PART II -THE AMENI:MENT, consisting of the following text and Schedules constitutes Alrendment No. 55 to the Official Plan for the Town of Aurora. - 2 - PART I -THE PREAMBLE Purpc?se of the AnendnE!lt The purpose of this amendnE!lt J.S to change the land use designation on the subject lands shown on Schedule "A" attached hereto and fanning part of this amendnE!lt from "Canrnercial" and "Urban Residential" to "Camnercial (Specific)" to pennit the integrated developmant of these lands for office and retail uses. Location The lands affected by this amendnE!lt CCli'Cprise Block 9, Registered Plan 65M-2298 and Part of Lot 90, Plan 246, municipally known as 151, 157 and 159 Yonge Street North. Basis of the AnendnE!lt Council has enacted this amendnE!lt m response to the following: 1. The proposed amendnE!lt will allow for an integrated COillllercial facility on these lands by means of irrprovements to the existing building on the southern portion of the site and the addition of a two storey structure to the north for office and retail uses, significantly irrproving the appearance of the site. 2. The surrounding carmercial uses and increasing traffic on Yonge Street have greatly reduced the desirability of this area for residential uses. 3. The additional carmercial floor space proposed at this location would be compatible and corrplimentary to the surrounding carmercial uses and given the limited scale of the proposed expansion should not have an irrpact on existing and proposed COillllercial develqmant in the area. 4. The adjacent residents to the east who were in attendance at the Public Planning meeting will be informad of the progress of the site plan through the approval process to ensure their input into the site planning of the proposed developmant. - 3 - PART II -THE AMENDMENT Introductory Statercent All of this part of the dOC1.1IIEilt entitled PART II -The 1\mendnent, consisting of the following text and attached Map designated Schedule "A" (land Use Plan) constitutes 1\mendnent No. 55 to the Official Plan for the Town of Aurora. Details of the Amendnent The Official Plan of the Town of Aurora is hereby am:nded as follows: Item (1): Item (2) : The area indicated on Schedule 'A' attached hereto and forming part of this am:ndnent is hereby redesignated from "Ccmnercial" and "Urban Residential" to "Conmercial (Specific)". Section 4 (land Use Plan) , Subsection 5 (Canmercial) is hereby am:nded by adding the following after the last paragraph of that Section: The following policies apply to Block 9, Registered Plan 65M-2298 and Part of IDt 90, Plan 246 designated "Conmercial (Specific)" as shown on Schedule "A" attached hereto and forming part of this plan. 1. The subject lands shall be developed as an integrated ccmnercial facility and shall be low rise, not exceeding two storeys in height. 2. The number of access driveways onto Yonge Street shall be limited and shall include provision for joint access with the adjoining ccmnercial lands to the south and a possible future driveway connection with the adjacent property to the north. 3. Through Site Plan Control, special attention shall be g~ven to the interface between the developnent site and the adjacent residential properties to the east; the impact of grade changes in relation to surrounding lands and the existing mature vegetation situated in the rear yards of the abutting residential properties; the provision for landscaping and buffer planting along Yonge Street and vehicular access to the site, including provision for joint access and driveway connections with adjoining properties to the north and south. - 4 - Implementation and Interpretation The :i.rrplementation and interpretation of this AmendnEnt shall be m accordance with the respective policies of the Aurora Official Plan, Zoning By-law and Site Plan Agreements. Explanatory Note Re: Official Plan Anendrrent No. 55 Official Plan Anendrrent #55 redesignates the lands shown below, being Block 9, Registered Plan 65M-2298 and Part of Lot 90, Plan 246 from "COilllErcial" and ~·u~ban Residential" to "COilllErcial (Specific)" subject to the following prov~s~ons: 1.
