BY-LAW NUMBER 3111-89
OF THE CORPORATION OF THE TOWN OF AURORA
BEING A BY-LAW to approve the sale of
certain lands from the Corporation of The
Town of Aurora to Dennis James Hutt and
Patricia Hutt (collectively hereinafter
called "Hutt").
WHEREAS, by virtue of an agreement entered into between Southold
Investments Limited and the Corporation of The Town of Aurora, pursuant to
Section 50 (6) of the Planning Act S.O. 1983 which is registered in the Land
Registry Office for the Land Titles Division for York Region Number 65, as
Instrument Number L T291559 (hereinafter called the "Agreement") and the
Transfer/Deed of Land registered in the said Land Registry Office as
Instrument Number L T324224, the Corporation of the Town of Aurora is now
seized and possessed of the lands described as Part of Parcel 29-1, Section
65M-2395, being Block 30, Plan 65M-2395, Town of Aurora, Regional
Municipality of York (hereinafter called the "Lands");
AND WHEREAS the Agreement requires that the Lands be conveyed to the owner
of adjacent lands upon registration of Plan 65M-2395, which plan has been
registered;
AND WHEREAS, Hutt is the owner of the lands adjacent to the Lands;
AND WHEREAS, by virtue of Section 50 (10) of the Planning Act, S.O. 1983,
this Corporation is empowered to dispose of the Lands at any time;
NOW THEREFORE, The Municipal Corporation of The Town of Aurora hereby
enacts as By-law Number 3111-89 of the Corporation of the Town of Aurora,
the following:
1. THAT the Lands are no longer required by this Corporation for
municipal purposes.
2. THAT the Lands be sold to Hutt for a consideration equa 1 to this
Corporation's legal, real estate appraisal and other administrative
costs as determined by this Corporation's Clerk.
3. THAT the Mayor and Clerk be authorized to sign and execute under the
seal of the Corporation of The Town of Aurora all documents necessary
to effect the disposition of the Lands to Hutt.
