BYLAW - Appoint Deputy Chief Building Official - 19890628 - 311689BY-LAW NUMBER 3116-89 OF THE CORPORATION OF THE TOWN OF AURORA BEING A BY-LAW to appoint a Deputy Chief Building Official. WHEREAS authority is granted pursuant to Subsection 2 of Section 3 of the Building Code Act, R.S.O., 1980, Chapter 51, as amended for appointing a Chief Building Official and such inspectors as are necessary for the purposes of the enforcement of this Act in the areas in which the municipality has jurisdiction; AND WHEREAS Section 27(o) of the Interpretation Act R.S.O., 1980, Chapter 219, as amended, provides that "words authorizing the appointment of a pub 1 i c officer or functionary or the appointment of a person to administer an Act including the power of appointing a deputy to perform and have all the powers and authority of such public officer or functionary or person to be exercised in such manner and upon such occasions as are specified in the instrument appointing him or such limited power and authority as the instrument prescribes"; AND WHEREAS the Council of the Corporation of the Town of Aurora deems it necessary and expedient to appoint a Deputy Chief Building Official to enforce the Building Code Act and Regulations thereunder in the absence of the Chief Building Official or when the Chief Building Official's workload warrants assistance; NOW THEREFORE the Council of the Corporation of the Town of Aurora enacts as follows: 1. THAT William Benzies is hereby appointed as Deputy Chief Building Official for the corporation of the Town of Aurora; 2. THAT the Deputy Chief Building Official shall have the same power and authority for enforcement of the Building Code Act, R.S.O., 1980, Chapter 51, as amended and the Regulations thereunder as the Chief Building Official; 3. THAT the Deputy Chief Building Official is hereby empowered to act, upon notice by the Corporation, when the Chief Bui 1 ding Official requires assistance or is unable to perform his duties for any of the following occasions or circumstances: A) annual leave or vacation B) illness, disability or death C) attendance at training courses, seminars or conferences D) bereavement leave E) attendance at court or legal proceedings F) a conflict of interest 4. THAT this By-1 aw shall come into force and take effect on the date of its final passing, and be effective until the 1st day of November, 1989.
