BYLAW - Amend 2213 78 (FTG Management) - 19890426 - 308689BY-LAW NUMBER 3086-89 OF THE CORPORATION OF THE TOWN OF AURORA BEING A BY-LAW to amend By-1 aw No. 2213-78. WHEREAS it,is deemed advisable to amend By-law number 2213-78; NOW, THEREFORE, the Council of The Corporation of the Town of Aurora enacts as follows: 1) That the zoning category applying to the lands shown in hatching on Schedule "A" attached hereto and forming part of this By-law is hereby amended from "Special Mixed Density Residential (R5) Zone" to "Special Mixed Density Residential (R5-18) Exception Zone". 2) That Section 14.3 is hereby amended by adding the following as Section 14.3.17 "Special Mixed Density Residential (R5-18) Exception Zone". "The existing building on the lands shown zoned R5-18 on Schedule 'A' together with a single storey addition to the rear of the existing structure of not more than 35 square metres may be used for medical, business and professional offices, provided the following: i) Not more than two doctors at any one time may occupy the premises; ii) The minimum required parking be 15 spaces; iii) Notwithstanding the provisions of Section 6.27.8, the minimum driveway width shall be 4.9 metres; iv) Notwithstanding the provisions of Section 6.31, the minimum required planting strip shall be 1.3 metres along the southern property line, 1.4 metres along the western, 1.4 metres along the rear portion of the eastern extending northward a minimum distance of 38 metres from the southern property 1 ine and nil adjacent to the driveway. A 1.5 metre high close board fence shall be provided along the entire southern property 1 ine extending northward along the eastern and western property 1 i nes a minimum distance of 55 metres and 3.5 metres respectively. 3) No part of this By-law will come into force until the provisions of the Planning Act have been complied with, but subject to such provisions the By-law will take effect from the day of passing thereof. READ A THIRD TIME AND FINALLY PASSED THIS 26th DAY OF April , 1989. ~~ \ ; Explanatory Note Re: Zoning By-law - 2 - By-law No.3o 'iSb-8f has the following purpose and effect: To amend By-law No. 2213-78 as amended to rezone the subject lands, being Lot 8, Registered Plan 68, municipally known as 73 Wellington Street East from "Special Mixed Density Residential (R5) Zone" to "Special Mixed Density Residential (R5-18) Exception Zone". The amendment is to permit the use of the existing building, and an addition at the rear having a maximum floor area of 35 square metres (377 square feet), for business, professional and medical offices subject to: a maximum of two doctors occupying the premises at any one time; a minimum of 15 parking spaces and a minimum driveway width of 4.9 metres (16 feet). An exception to the standard By-law requirement for 1.5 metre (4.9 foot) buffer strip has been granted, with requirements for a planting strip of 1.3 metres (4.3 feet) along the southern property line, 1.4 metres (4.6 feet) along the western, and 1.4 metres (4.6 feet) along the rear portion of the eastern; in order to retain the minimum driveway width of 4.9 metres (16 feet), the required planting strip adjacent to the driveway, shall be nil. In order to screen the parking from the adjacent properties, a 1.5 metre (4.9 foot) high close board fence shall be provided along the southern property 1 ine extending northward a minimum distance of 55 metres ( 180 feet) a 1 ong the eastern boundary; in 1 i ght of the existing trees on the abutting lands to the west, screening will be achieved through a combination of fencing and cedar hedging along the western boundary.
