BYLAW - Amend 2213 78 (Coscan) - 19890516 - 315589BY-LAW NUMBER 3155-89 OF THE CORPORATION OF THE 'l'CmN OF AURORA BEING A BY-LAW to amend By-law No. 2213-78 WHEREAS it is deemed advisable to amend By-law number 2213-78. NCM THEREFORE the Council of the Corporation of the 'Ibwn of Aurora enacts as follows: 1. That the zoning category applying to the lands shown in shading on Schedule 'A' attached hereto and fanning part of this ·By-law is hereby amended from "Shopping Centre Cormrercial (C4) Zone", "Environmental Protection (E.P.) Zone" and "Shopping Centre Carti!Ercial (C4-1) Exception Zone" to "Environmental Protection (E.P.) Zone", "Environmental Protection (EP-5) Exception Zone", and "Shopping Centre Commercial (C4-1) Exception Zone". 2. That Schedule 'C' is hereby deleted and replaced by Schedule 'C' attached hereto and forming part of this By-law. 3. That Section 23. 3 .1 is hereby amended by deleting the contents ·of that Section and replacing them with the following: 23.3.1 The lands shown zoned "Shopping Centre Carti!Ercial (C4-1) Exception Zone" on Schedule 'A' may only be used rn accordance with the following provisions and for the following uses: 23.3.1.1 Uses Permitted: Building A: In accordance with Section 23.1 hereof, and including storage uses accessory to permitted oarnmercial uses. Building B: i) Main Floor -CoimJercial uses as follows: retail stores restaurants personal service shops business and professional offices studios banks and other financial establishments ii) Second Floor: Units 1-11 inclusive, 16, 17, 24-28 inclusive, 30-39 inclusive, and 41-49 inclusive: one dwelling unit for each unit. Units 12-15 inclusive, 18 and 40: carti!Ercial uses as listed in (i) above. Units 19-23 and 29: carti!Ercial uses as listed 1.n (i) above or one dwelling unit for each unit. iii) Cellar -Storage uses accessory to permitted Carti!Ercial uses, except that Unit 13 may be used as a banquet roam carplementary to the main floor tavern. - 2 - 23.3.1.2 Building Specifications: The arrangement of buildings, parking areas and landscaping shall be in general accordance with the layout indicated on Schedule 1 C 1 • 4. That Section 30 is hereby amended by adding the following as Section 30.3. 6 "Environmental Protection (EP-5) Exception Zone". "The lands shown zoned EP-5 on Schedule 1 A 1 may be used for parking in addition to the uses permitted in Section 30.1 hereof." 5. No part of this By-law will came into force until the provisions of the Planning Act have been canplied with, but subject to such provisions the By-law will take effect from the day of passing thereof. WEST, '' - 3 - Explanatory Note Re: Zoning By-law By-law has the following purpose and effect: Tb amend By-law 2213-78 the Zoning By-law in effect in the Tbwn of Aurora to rezone the subject lands, being Part Lot 1, Plan 246 located on the northwest corner of Yonge Street and Orchard Heights Boulevard from "Shopping Centre Carrmercial (C4) Zone", "Environmantal Protection (E.P.) Zone" and "Shopping Centre Ccmrercial (C4-l) Exception Zone" to "Environmantal Protection (E. P.) Zone", "Environmantal Protection (EP-5) Exception Zone" and "Shopping Centre Ccmrercial (C4-l) Exception Zone". The amendment is to pennit a two storey addition to the existing structure with conmercial use of the ground floor and residential use of the second storey. The rezoning of the western portion of the lands is to include the table lands of the entire site in the same zone category for administrative purposes. The EP-5 zone is to pennit parking in that portion of the floodplain lands.
