BEING A BY-LAW to
declare the office of former
Councillor Chris Ballard to
be vacant for the Town of
Aurora.
WHEREAS paragraph 259(1)(d) of the Municipal Act, 2001, S.O. 2001, c. 25, as
amended (the "Act") states that the office of a member of council of a municipality
becomes vacant if the member resigns from his or her office and the resignation is
effective under section 260 of the Act;
AND WHEREAS subsection 260(1) of the Act states that a member of council of a
municipality may resign from office by notice in writing filed with the clerk of the
municipality;
AND WHEREAS on June 17, 2014, Councillor Chris Ballard resigned from office by
notice in writing filed with the Town Clerk, as he was the successful candidate for office
of a member of the Legislative Assembly of Ontario in the June 12, 2014 provincial
election in the riding of Newmarket -Aurora;
AND WHEREAS subsection 262(1) of the Act states that if the office of a member of a
council becomes vacant under section 259 of the Act, the council shall at its next
meeting declare the office to be vacant;
AND WHEREAS the Council of The Corporation of The Town of Aurora deems it
necessary and expedient to declare the office of a member of council, being Chris
Ballard, to be vacant;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
AURORA ENACTS AS FOLLOWS:
1. THAT the Council office and seat formerly held by Councillor Chris Ballard is
hereby declared to be vacant.
2. THAT this By-law shall come into full force and effect on the date of final
passage hereof.
