OF THE CORPORATION OF THE TOWN OF AURORA
BEING A BY-LAW of The Corporation
of the Town of Aurora in The
Regional Municipality of York for
the submission to a vote of
questions under the provisions of
the Liquor Licence Act, R.S.O. 1980
to the qualified electors in that
part of the municipality annexed in
1971 from the Township of
Whitchurch.
WHEREAS, at the time of the coming into force of the Ontario Temperance
Act, a by-law dated 1909 was in force within the limits of the Township of
Whitchurch prohibiting the sale of liquor by retail therein;
AND WHEREAS, by Section 33(1) of the Liquor Licence Act, it is provided
that no annexation or amalgamation shall affect the operation of the Liquor
Licence Act at the time of the annexation or amalgamation in the areas
annexed or amalgamated until such operation has been affected pursuant to a
vote under the Liquor Licence Act in the areas annexed or amalgamated;
AND WHEREAS, under Section 26 of the Liquor Licence Act, R.S.O. 1980, the
Council of a municipality may submit to a vote of the persons qualified to
be entered on the voters' list and to vote at elections in the municipality
any question (or questions) set forth in the Liquor Licence Act;
AND WHEREAS, the Counci 1 considers it expedient and desirable to submit
certain questions to a vote of the persons in that part of the Town of
Aurora that was annexed from the Township of Whitchurch in 1971, who are
qualified to vote;
AND WHEREAS, the Council considers it expedient and desirable that the
vote on the question shall be taken upon the day upon which, under the
Municipal Elections Act, a poll will be held at the next election of members
of Council;
AND WHEREAS, it is necessary to provide by by-1 aw for the submission of
the said questions to the persons qualified to vote thereon and for the
taking of their votes thereon.
NOW THEREFORE, the Council of the Corporation of the Town of Aurora in the
Regional Municipality of York enacts as follows:
1. Under the Liquor Licence Act, there is hereby submitted to a vote
of the persons qualified to be entered on the voters' list and to
vote at elections in that part of the municipality annexed in 1971
from the Township of Whitchurch the following questions pursuant
to the regulations under the Liquor Licence Act:
Are you in favour of the sale of spirits, beer and wine under
a dining lounge licence for consumption on licensed premises
where food is available?
Are you in favour of the sale of spirits, beer and wine under
a lounge licence for consumption on licensed premises?

2. The vote shall be taken upon the date upon which, under the
Municipal Elections Act, a poll will be held at the next election
of members to Council.
3. That the provisions of this By-law shall come into force and be
effective upon final passage thereof.
