BYLAW - OPA 48 - 19880406 - 297788ADOPTION BY-LAW FOR OFFICIAL PLAN AMENDMENT NO. 48 BY-LAW NUMBER 2977-88 OF THE MUNICIPAL CORPORATION OF THE TOWN OF AURORA The Council of the Corporation of the Town of Aurora, under Section 17 (6) of the Planning Act, 1983, hereby enacts as follows: 1. Official Plan Amendment No. 48 for the Town of Aurora, consisting of the attached maps and explanatory text, is hereby adopted. 2. The Clerk is hereby authorized and directed to make application to the Minister of Municipal Affairs for approval of Official Plan Amendment No. 48 for the Town of Aurora. 3. PART II -THE AMENDMENT, consisting of the following text and maps (designated Schedule 'A') constitutes Amendment No. 48 to the Official Plan for the Town of Aurora. - 2 - PART I -THE PREAMBLE Purpose of the Amendment The purpose of this amendment is to change the land use designation on the subject lands shown on Schedule 'A' attached hereto and forming part of this amendment from "Rural" to "Urban Residential" and "Urban Separator" to permit the site to be developed for multi-unit residential uses. Location The lands affected by this amendment are located on Part Lot 86, Concession I E.Y.S. Basis of the Amendment Council has enacted this amendment in response to the following: 1. 2. 3. 4. 5. Recognition that certain lands on the north side of St. John's Sideroad are not within the flood plain and are suitable for development. Lands on the south side of St. John's Sideroad are designated for Urban Separator and Urban Res i denti a 1 development through the approva 1 of Official Plan Amendment No. 37, hence the proposed development would be adjacent to an urbanizing area. An extensive amount of open space is associated with the proposed developme"nt, which allows for the maintenance of a rural appearance to the gateway to the Town and allows for a natural buffer between the Town of Newmarket and the Town of Aurora. Traffic on Yonge Street (Highway 11) will not be severely impacted since all access to the site will be from St. John's Sideroad. Through Site Plan Control, adequate landscaping and design of the site will allow the development to be sensitive to the surrounding area. l l i i I ! I i ' ! l I i l ; ' ! - 3 - PART II -THE AMENDMENT Introductory Statement All of this part of the document entitled PART II -The Amendment, consisting of the following text and attached map designated Schedule 'A' (Land Use Plan) constitutes Amendment No. 48 to the Official Plan for the Town of Aurora. Details of the Amendment The Official Plan of the Town of Aurora is hereby amended as follows: Item (1): The area indicated on Schedule 'A' attached hereto and forming part of this amendment is hereby redesignated from "Rural" to "Urban Residential" and ''Urban Separator''. Item (2): Section 4.4 is hereby amended by adding Section 4.4C(x). The following policies apply to that part of Lot 86, Concession I E. Y .S. designated "Urban Residential" as shown on Schedule 'A' attached hereto and forming part of this plan. i) A multiple family residential condominium apartment complex may be permitted on the lands shown on Schedule 'A'. i i) The maximum number of units permitted in the apartment complex shall be 90 units exclusive of residences for caretakers of which a maximum of one per apartment building shall be permitted. iii) Not more than three separate apartment buildings may be constructed even if the bui 1 dings share a common foundation or basement. iv) The maximum height of any structure shall be 4 storeys exclusive of elevator rooms, mechanical rooms, glass atria, or other appurtenances accessory to and incidental to the structures. v) Other structures and facilities such as recreation centres, security guard houses, parking 1 ot gatehouses, swimming pools, tennis courts and similar uses may be . permitted provided they serve the development complex and are intended for use by or for the residents of the complex. vi) All buildings shall be set back a minimum of 14.0 metres from Highway #11 (Yonge Street). vii) It shall be the policy of this Plan to zone the lands designated "Urban Residential" on Schedule 'A' in an appropriate high density zoning category with specific exception provisions to insure implementation in accordance with the policies of this plan. I I t ~ ~ I i I " ~ l I I viii) ix) x) xi) xii) - 4 - The site plan required for the proposed development shall insure that floodlights, security lights, i 11 umi nated signs, and lighted entrances sha 11 be designed and located so that no direct light or glare effects adjoining land uses, or the safety of traffic on adjacent roads. Special attention shall be given in the site plan to the interface between the development site and Highway #11. In this regard the site plan shall incorporate substantial aesthetic bermi ng and/or landscaping along the Highway #11 (Yonge Street) property line. The berm shall incorporate in its design a suitable mixture of decorative walls, fences, hedges, trees, shrubs or other ground cover to provide an overall screening effect. The intent of this screening is to insure that this northern entrance to the Town of Aurora is attractive, is in keeping with the spacious rural and open space character of the surrounding area, and continues to allow for a functional separation between the urban area and adjacent non-urban uses. It is intended that the development will not have vehicular access to Yonge Street but will be serviced directly from the St. John's Sideroad at a location to be approved by the Town of Aurora and acceptable to the Ministry of Transportation and Communications. ·It is recognized that certain improvements may be required to the St. John's Sideroad and/or to its intersection with Yonge Street caused by this development in combination with other developments in the area. It shall be the policy of the Town to require the costs for such improvements to be shared proportionately by the developments proposed in the area as part of any implementing development agreements, such that there shall be no financial burden on the municipality. The development proposed shall be on the basis of full municipal water and ·sanitary services. Accordingly, prior to any development occurring, the Regional Commissioner of Engineering shall advise that water and sanitary sewage capacity is available and has been allocated by resolution of the Town of Aurora. Prior to the commencement of a development, a balanced cut and fill permit shall be approved by the Lake Simcoe Region Conservation Authority where any alterations to a floodline are contemplated. In this regard the policies of Section 4.11 of this plan (Environmental Protection Area) shall apply. It is intended that development will only be permitted in those areas of the subject property which are situated outside of the Regional Flood Plain as altered. All other lands shall remain in their natural state or be put to a use as permitted by Section 4.11. xiii) xiv) xv) - 5 - Prior to any development a storm water management study shall be undertaken to the satisfaction of the Town and the Lake Simcoe Region Conservation Authority. Once the study report is approved the owner shall be required to implement the findings and recommendations of the study as part of the implementing development agreement. Unless precluded, altered or exempted by the policies of subsection (i) to (xiii) inclusive as set out above, the policies of Section 4.4.C of this plan shall apply. The lands designated "Urban Separator" located on Lot 86, Concession I E. Y .S. shall be subject to the following policies: (a) All proposals for development in the area designated "Urban Separator" shall be subject to a site plan agreement which will include a detailed landscaping plan. (b) The lands designated "Urban Separator" may be used only in conjunction with the adjoining lands designated "Urban Residential" and provided that no buildings or structures are located within the flood plain areas as defined by the Lake Simcoe Region Conservation Authority. (c) It is intended that in the "Urban Separator", natural vegetation, and in particular existing woodlots, shall be maintained. (d) Parking areas shall be screened from the streets by planting and landscaping. Parking areas will be located as far from major streets as practical and, where possible, behind buildings. (e) It shall be a policy of this Plan to zone all lands designated "Urban Separator" in a separate zoning category in the implementing zoning by-law.
