BEING A BY-LAW to
amend By-law Number
5365-11 by delegating
further authority over
materials of significant
cultural heritage.
WHEREAS section 23.1 of the Municipal Act, 2001, S.O. 2001, c. 25, as amended
(the "Act') authorizes a municipality to delegate its powers and duties under the Act
or any other legislation to a person or body, subject to the restrictions set out in Part
II of the Act, and this by-law is being made in accordance with Part II of the Act;
AND WHEREAS on November 22, 2011, the Council of The Corporation of the Town
of Aurora (the 'Town") passed By-law Number 5365-11 regarding the delegation of
power to consent to alterations of designated heritage properties;
AND WHEREAS the Council of the Town deems it necessary to amend By-law
Number 5365-11 to delegate authority to the Program Manager, Heritage Planning
(the "Manager") and to the Heritage Advisory Committee to review and process
applications for accepting and distributing architectural materials of significant cultural
heritage;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
AURORA ENACTS AS FOLLOWS:
1. THAT paragraph 1 of By-law Number 5365-11 be and is hereby amended by
deleting the following:
"... Manager of Heritage Planning and Urban Design (the "Manager") ..."
and replacing it with the following:
"... Program Manager, Heritage Planning (the "Manager") ..."
2. THAT By-law Number 5365-11 be and is hereby amended by inserting the
following:
"2.1 THAT the Council of the Town hereby delegates to the Manager the
following authority:
(a) to process and review applications for accepting and distributing
architectural materials of significant cultural heritage (the
"salvage material") as part of the Architectural Salvage Program;
(b) to approve, pursuant to the Guide to the Architectural Salvage
Program, applications for accepting and distributing salvage
material as part of the Architectural Salvage Program, in cases
where an application adheres to the requirements and criteria set
out in the Guide to the Architectural Salvage Program and there
are no fees involved as part of the transfer of the salvage
material; and
(c) to reject any applications for accepting and distributing salvage
material as part of the Architectural Salvage Program in cases
where the application is incomplete, frivolous or manifestly non-
compliant with the criteria and requirements set out in the Guide
to the Architectural Salvage Program.

2.2 THAT the Manager shall forward to the Heritage Advisory Committee a
summary of any applications processed by the Manager as required by
the Guide to the Architectural Salvage Program.
2.3 THAT the Council of the Town hereby delegates to the Heritage
Advisory Committee the authority to consider and recommend any
applications for accepting and distributing salvage material as part of
the Architectural Salvage Program that do not fall under the authority
for approval or rejection by the Manager pursuant to section 2.1."
3. THAT this By-law shall come into full force and effect on the date of final
passage hereof.
