BYLAW - Amend 2213 78 - 19870629 - 291887,, BY -LAW NUMBER J.. '1//?-'i' 7 OF THE MUNICIPAL CORPORATION OF THE TOWN OF AURORA BEING A ZONING BY-LAW WHEREAS it is deemed advisable to amend By-law number 2213-78. NOW THEREFORE the Council of the Corporation of the Town of Aurora enacts as follows: 1. Section 9 is hereby amended by adding the following as Section 9.6.5 "Estate Residential Exception Zone-ER-4". i) USES PERMITTED In accordance with Section 9.1 hereof, and provided that the lands shown zoned ER-4 -Estate Residential Exception Zone, on Schedule 'G' attached hereto, may not be developed into more than 11 residential lots. ii) Lot Specifications Lot Area (minimum) Lot Frontage (minimum) iii) Siting Specifications Front Yard (minimum) Rear Yard (minimum) Interior Side Yard (minimum) on: -one side - 9 metres -other side -4.5 metres -4,000 square metres 75 metres 10 metres 9 metres Exterior Side Yard (minimum) -15 metres iv) Building Specifications In accordance with Section 9.2.3 of this By-law. 2. Section 9 is hereby amended by adding the following as Section 9.6.6 "Estate Residential Exception Zone-ER-5". i) USES PERMITTED In accordance with Section 9.6.5 ii) Lot Specifications Lot Area (minimum) -4,000 square metres Lot Frontage (minimum) 34 metres iii) Siting Specifications In accordance with Section 9.6.5. . ' - 2 - iv) Building Specifications In accordance with Section 9.2.3 of the by-law 3. Section 10 is hereby amended by adding the following as Section 10.7 "Detached Dwelling First Density Residential Exception Zone-R1-5". 10.7.1 USES PERMITTED In accordance with Section 10.1 hereof. 10.7.2 ZONE REQUIREMENTS 10.7.2.1 Lot Specifications Lot Area (minimum) -950 square metres Notwithstanding any other provision to the contrary the area calculation shall be based on the sum of the areas which are zoned R1-5 and 0-6 in each lot on the registered plan. Lot Frontage (minimum) -22 metres On any lot having a "R1-5" and a "0-6" zone no dwellings or accessory buildings may be constructed closer than 9 metres to the 0-6 zone as defined on Schedule 'G'. 10.7.2.2 Siting Specifications Front Yard (minimum) Rear Yard (minimum) 8 metres 9 metres Notwithstanding any other provisions to the contrary the minimum rear yard shall be calculated from the rear of the dwelling to the rear of the R1-5 zone. Exterior Side Yard (minimum) - 8 metres Interior Side Yard -If two adjoining lots have a combined minimum frontage of 60 metres or greater then the minimum side yard required is 1.5 metres, with a minimum separation distance of 5.0 metres between any two adjacent dwelling units. -If two adjoining lots have a combined minimum frontage of less than 60 metres then the minimum' side yard required is 1.2 metres, with a minimum separation distance of 4.0 metres· between any two adjacent dwelling units. -The provisions of Section 7 .1.1 shall not apply to the lands zoned "R1-5". , .. . ' 4. 5. . __ :1; ·-···.L - 3 Notwithstanding the siting requirements of Section 10.7.2.2, as set out above, where a R1-5 zone abuts an 0-6 zone no part of any building, structure or use accessory thereto such as a patio or driveway shall encroach upon the 0-6 zone. 10.7.2.3 Building Specifications In accordance with Section 10.2.3 of this By-law. Section 31 is hereby amended by adding the following as Section 31.3.5. "Notwithstanding the provisions of Section 31.1 respecting permitted uses, the lands shown zoned '0-5 -Major Open Space Exception Zone' shall not be used, except for the following uses: -conservation -forestry -parks, public and private -wildlife areas i) Zone Requirements No building or structures shall be erected in this zone whether or not ancillary to the uses permitted. Section 31 is hereby amended by adding the following asSection 31.3.6. "Notwithstanding the provisions of Section 31.1 respecting the permitted uses, . the 1 ands shown zoned "0-6 -Major Open Space Exception Zone" shall not be used, except for the following uses: -conservation -wildlife areas i) Zone Requirements No buildings or structures shall be erected in this zone whether or not ancillary to the uses permitted, and the lands within this zone shall be maintained in their natural state. 6. That Schedule 'A' is hereby amended by changing the zoning categories applying to the lands shown in dark outline on Schedule 'A' attached hereto and forming part of the By-law from "RU -Rural General" to "ER-4 Estate Residential Exception Zone", "ER-5 Estate Residential Exception Zone", "Rl-5 -Detached Dwelling First Density Residential Exception", "0-5 -Major Open Space Exception", and "0-6 Major Open Space Exception Zone" more particularly described on Schedule "G" attached hereto and forming part of this By-law. 7. That Schedule "G" is hereby added to By-law 2213-78. ... - 4 - 8. No part of this By-law will come into force until the provisions of the Planning Act have been complied with, but subject to such provisions the By-law will take effect from the day of passing thereof. Expl?natory Note _ .. . . . By-law~q/1-~1 has the following purpose and effect: To amend By-law Number 2213-78 the Zoning By-law in effect from Rural to ER-4 and ER-5 both of which are Estate Residential Exception Zones specifically written to implement a draft plan of subdivision which has 11 large estate type lots along St. John's Sideroad; "R1-5" which is again specifically written for the 198 large urban lots in the subdivision plan; "0-5" which is an open space zone applying to lands that will be publicly owned but where no buildings or structures will be permitted; and "0-6" an open space zone which will apply to parts of the residential lots usually at the rear of the lot where it is intended that the lands will remain in their natural state. The "0-6" zone will be strengthened and made further enforceab 1 e by registering covenants on the title of all effected lots which will prevent tree cutting or other alterations. The imperial equivalents of the metric zone standards are listed below by zone. If the combined frontage is less than 60 metres (196.8 feet) than the dwelling may be as close as 1.2 metres (3.9 feet) from a lot line provided it is not closer to an adjoining dwelling than 4 metres (13.1 feet). This is done to allow buildings to be shifted to best suit the grades on the site and preserve tree cover.
