ADOPTION BY-LAW FOR OFFICIAL PLAN AMENDMENT NO. 41

OF THE MUNICIPAL CORPORATION OF THE TOWN OF AURORA
The Council of the Corporation of the Town of Aurora, under Section
17(6) of the Planning Act, 1983, hereby enacts as follows:
1. Official Plan Amendment No. 41 for the Town of Aurora,
consisting of the explanatory text, is hereby adopted.
2. The Clerk is hereby authorized and directed to make application
to the Minister of Municipal Affairs and Housing for approval of
Official Plan Amendment No. 41 for the Town of Aurora.
3. This By-law shall come into force and take effect on the day of
the final passage thereof.

This Amendment to the Official Plan for the Town of Aurora, which
has been adopted by the Council of the Corporation of the Town of Aurora,
is hereby approved in accordance with Section 17 of the Planning Act, 1983
as Amendment No. 41 to the Official Plan for the Town of Aurora.

PART I -THE PREAMBLE does not constitute part of this Amendment.
PART II -THE AMENDMENT, consisting of the following text constitutes
Amendment No. 41 to the Official Plan for the Town of Aurora.

PART I -THE PREAMBLE
The purpose of this amendment is:
1. To delete the existing policies and to provide new policies
limiting the use of the property designated commercial in part of
Lot 84, Concession 1 E. Y .S.
LOCATION -------
This amendment consists of one part which shall be referred to as item
(1 ).
Item (1): Section 4.5(e) is deleted and special policies regarding the
subject lands are to be added to Section 4 (Land Use Plan)
Subsection 5 (Commercial) of the Official Plan in place of that
section.

Council is enacting this amendment on the following basis.
The subject property has frontage on Yonge Street and therefore well
located for a use which will at least in part rely on passing traffic
for its viability.
2. The applicants propose a substantial buffer area composed of
landscaped open space adjacent to Yonge Street, and the northern and
eastern boundaries of the property. As well the site will be
landscaped internally to provide an attractive entrance to the
community.
3. An existing automotive use and an industrial food processing plant are
located to the south of the property. The proposed use, a well
landscaped and attractively designed automotive sales campus will
provide a transition between the proposed residential uses to the north
of the property and the automotive and industrial uses to the south.
4 . Grouping together of automotive sales areas in one location is
considered to be advantageous to the community in that a convenient,
attractive, service will be available to the residents.

PART II -THE AMENDMENT

The Official Plan is hereby amended as follows:
Item (1): Section 4 (Land Use Plan), Subsection 5 (Corrmercial) (e) of the
Official Plan of the Town of Aurora is amended by deleting the
present subsection and adding the following in the place:
The following policies apply to those lands designated Corrmercial
in part of Lot 84, Concession 1, E. Y .s.
Because the subject property is located at the municipality's
northern urban entrance, it is Council's intention to ensure that
high standards of urban design are maintained on the site and
that a substantial landscaped buffer area is provided at the
northern, eastern boundaries of the property and along Y onge
Street. The use of the site will be limited to an automobile
sales campus comprising several automotive dealerships.
i. In order to ensure that surrounding residential areas or
areas proposed for residential purposes are protected from
the Corrmercial uses, a substantial landscaped buffer area
averaging about 5 metres in width shall be required on the
site, adjacent to Old Yonge Street and along Yonge Street.
This width of this buffer area shall not be less than 2
metres. At the northern edge of the property the
landscaped buffer area shall be not less than 10 metres in
width. The landscaped area may contain such berms, walls,
fences, hedges, trees, shrubs, or other ground cover as are
deemed necessary to protect adjacent uses and provide an
attractive Yonge Street frontage.

ii. Council shall require that a 'master' site plan agreement be
entered into for the entire property concerning the
landscaping of the site and protection of adjoining lands
upon any application for rezoning. This site plan will also
specify locations of entrances onto Yonge Street. As well,
the lighting facilities, design of parking areas, design of
buildings, relationship of the proposed buildings to adjacent
buildings, street and exterior areas and individual site
landscaping shall be specified in the site plans.
iii. Design and massing of the various buildings must be
compatible both in respect to other buildings on the site
and those buildings surrounding the lands in question. The
design of buildings shall be in accordance with good
architectural standards. Exterior cladding of the buildings
shall be compatible throughout the block.
iv. Floodlights, security lighting and illuminated signs shall be
located so that no direct light or glare affects adjoining
land uses or the safety of traffic on adjacent roads.
v. It is intended that lots will not have individual access to
Yonge Street, but will be jointly serviced by an internal
service road system with limited Yonge Street access.
Generally entrances off of Old Yonge Street will not be
permitted.
vi. The policies of Section 4.11 "Environmental Protection
Area" shall apply to the portions of the site which are
within the flood limits of Tannery Creek as defined by the
South Lake Simcoe Conservation Authority.
vii. Prior to any rezoning of the amendment area, a traffic
report and overall site plan showing the location and design
of access points of Yonge Street (Highway 11) shall have
been approved by the Ministry of Transportation and
Communications.
The implementation and interpretation of this Amendment shall be in
accordance with the respective policies of the Aurora Official Plan.
