BY-LAW NUMBER 2838-86
OF THE MUNICIPAL CORPORATION OF THE TOWN OF AURORA
BEING a by-law to authorize the construction of
a Family Leisure Complex and facilities on
Industrial Parkway, Part Lots 87 and 88, and
Part Lot 103 of Plan 246, as will be known as
125 Industrial Parkway North, in the total
estimated amount of $6,712,500. 00.
AND WHEREAS Council has determined that it is desirable that tenders and
construction be undertaken as soon as possible,
AND WHEREAS Section 208 (57) of the Municipal Act (Chapter 302) of the
Statutes RSO 1980 as amended authorizes a Council to establish and construct
such a facility,
AND WHEREAS, a portion of the financing of such project shall require
borrowing approval beyond the term of this Council and for a period not
to exceed 20 years as provided for in Section 64 of the Ontario Municipal
Board Act RSO 1980, Chapter 34 7,
NOW THEREFORE the Municipal Council of the Town of Aurora enacts as
follows:-
1. That the construction of the Aurora Family Leisure Complex, in the
total estimated amount of $6,712, 500. 00 be authorized as approved
by the Ontario Municipal Board, by its Order
dated , has approved and authorized the
total expenditure proposed and the long term financing of a maximum
of $2, 000, 000. 00 for a period not to exceed 20 years.
2. That the plans, specifications and tenders of Moffat Kinoshita Associates
Incorporated as revised on February 25th; 1986 be authorized for
construction.
3. That Moffat Kinoshita Associates Incorporated, shall provide all the
services, plans, profiles, specifications and supervision and being
responsible to and reporting to the Clerk-Administrator acting and
authorized by Council to see that the work is carried out and completed
in a satisfactory manner.
4. That Council, shall specifically approve of construction project agreements
by resolution as may be necessary from time to time, and shall by
such resolution authorize the Mayor and Clerk to enter into an agreement
with some person or persons, firm or corporation and to sign any
other documents necessary for construction of this work, subject to
the approval of this Council to be declared by resolution.

THE BOARD ORDERS that this application be granted and the applicant
may proceed with the said undertaking and may pass all requisite
by-laws, and The Regional Municipality of York may issue debentures
therefor not exceeding $2,000,000.00 or not to exceed the net cost of
such undertaking to the applicant, whichever is the lesser, for a term
not to exceed twenty years, provided that the council of the applicant
corporation and the council of The Regional Municipality of York in
exercising any power approved by this order shall comply and conform
with all statutory and other legal requirements related thereto .
