OF THE MUNICIPAL CORPORATION OF THE TOWN OF AURORA
Being a By-law to adopt Amendment No. 26 to the Official
Plan of the Aurora Planning Area.
The Council of the Corporation of the Town of Aurora in
accordance with the provisions of Section 17(1) of The
Planning Act enacts as follows:
1. Amendment No. 26 to the Official Plan of the Aurora
Planning Area, consisting of the attached explanatory
text, is hereby adopted.
2. That the Municipal Corporation of the Town of Aurora
make application to the Ministry of Housing for approval
of said Amendment.
3. The Clerk is hereby authorized and empowered to make or
cause to be made on behalf of this Corporation such
application as may be necessary to the Ministry of
Housing for approval of said Amendment and to execute
under the Corporate Seal such documents as may be
required for the above purposes.

AMENDMENT NO. 26
TO THE
OFFICIAL PLAN FOR THE
AURORA PLANNING AREA
This amendment to the Official Plan for the Aurora
Planning Area, which has been adopted by the Council
of the Corporation of the Town of Aurora, is hereby
approved in accordance with section 21 of the Planning
Act as Amendment No. 26 to the Official Plan for the
Aurora Planning Area.

PART I: THE CERTIFICATION
The explanatory text constituting Amendment No. 26 to
the Official Plan of the Aurora Planning Area, was
adopted by the Council of the Town of Aurora by By-law
26.3fl:..a3-,:in accordance with Section 17 of The Planning

This Amendment to the Official Plan of the Aurora Plan-
ning Area which has been adopted by the Council of the
Town of Aurora is hereby approved in accordance with
Section 17 of The Planning Act, as Amendment No. 26 to
the Official Plan of the Aurora Planning Area.
AMENDMENT NO. 26
TO THE OFFICIAL PLAN OF THE AURORA PLANNING AREA
PART II: THE PREAMBLE
1. TITLE AND COMPONENTS
This amendment comprising the text and schedule
shall be known as Amendment 26 to the Official Plan of
the Aurora Planning Area.
2. THE PURPOSES
The purpose of this amendment is to:
(1) Change the land use designation applying to the
subject lands from 'Rural' to 'Estate Residential'.
(2) To set a policy applying only to the subject site
respecting the method of servicing of the subject
property.
3. LOCATION
The subject lands are Block 37 of of Registered
Plan M-2012 as shown on Schedule 'A' which forms part
of this amendment.
4. BASIS OF THE AMENDMENT
This amendment has been enacted by Council in
response to the following:
(1) The applicants have had engineering studies and a·
landscape analysis carried out which support the
use of the subject lands for Estate Residential
uses.
(2) The subject lands are part of a Registered Plan of
subdivision which are separated from the remainder
of the subdivision by a deep and heavily treed
stream valley. At the time that the subdivision
was registered, Council agreed to the future use
of the su·bject lands for residential purposes.

(3) The lands are rolling with an attractive back drop
of trees which allows development of the property
while preserving the treed and extreme slopes of
the river valley.
(4) The lands are mainly Class 6 agricultural land
according to the Canada Land Inventory and therefore
are not good agricultural land.
(5) Public meetings have been held regarding the
proposal and a public concensus reached that
estate type .8 hectare lots are the most acceptable
form of development.
(6) The Ministry of the Environment has recently
determined that the subject site is located in the
direction of groundwater flow from the area of
York Sanitation Site No. 1. That Ministry has
advised that there is an existing contamination
plume migrating from the waste disposal site in
the direction of the subject site and this plume
is presently being more accurat.ely delineated,
although indications are that the leading edge of
the plume has reached the site. Staff of the
Ministry of the Environment have therefore indicated
that they are opposed to the use of individual
wells within the development area and recommend
that arrangements be made to service the area with
municipal water supply.
Because this is a unique situation, Council are of
the opinion that should the only alternative be to
provide municipal water to the subject site this
alternative should be taken due to the commitments
made to the land owner. It is not Council's
intent that other properties within the Estate
Residential designation will be provided with municipal
water supply.

PART III: THE AMENDMENT
STATEMENT OF PRINCIPLES AND POLICIES
GOVERNING AMENDMENT NO. 26
1. The Official Plan is amended as follows:
(i) The land use category applying to Block 37 of
Registered Plan M2012 is hereby amended from
Rural' to 'Estate Residential' as shown on Schedule
'A' which forms part of this amendment.
(ii) That Section 4.8 (G) of the "Policies'' be amended
by adding the following clause.
"Due to Ministry of the Environment's concern
that the groundwater within the subject site
is contaminated, the lands which comprise
Block 37 of Registered Plan M2012 may be
provided with municipal water supply. However,
it is not Council's intention that other
properties within the Estate Residential
category not already developed, within this
area or any other area within the municipality
will be provided with municipal water supply.
