TO CLOSE UP AND STOP UP PART OF ENGELHARD DRIVE, AS LAID OUT
IN PLAN M-2012, AURORA.
WHEREAS it is deemed expedient in the interests of the Corporation of
the Town of Aurora (hereinafter called 11AU1'ora 11) that part of Engelhard
Drive as laid out in Plan M-2012, Aurora, and described in Schedule '~11
attached hereto, be closed and stopped up and the land sold to the
adjoining land owner;
WHEREAS that part of Engelhard Drive which is to be closed and stopped
up has never been opened for vehicular or pedestrian traffic.
AND WHEREAS Aurora, is the OWner'of Lots 2-20 inclusive, Plan M-2012, AU1'ora,
and Part of Lot 1, Plan M-2012, being Parts 5, 8 and 34, as shown on a
Preliminary Plan of Survey of Part of Lot 1 and all of Lots 2-20, inclusive
and Block 44 (Reserve) and parts of Block 36 and Block 46 (Reserve) and
all of Engelhard Drive, Registered Plan M-2012, Town of Aurora, dated
May 3rd, 1983 and prepared by Holding & Jones Limited, Ontario Land Surveyors,
a copy of which is attached hereto as Schedule 11B11 , which lands are all the
adjoining lands to that part of Engelhard Drive which is to be closed and
stopped up and sold;
AND WHEREAS it is the intention of Aurora to open a new part of Engelhard
Drive in Plan M-2012, Aurora, to replace that part that is to be closed
and stopped up and sold, which new part is laid out and described as
i 5arts 7, 8, 9, 10, 17, 18, 19, 21, 22, 23, 24, 32, 33, 34, 35 and 36 in
the said Plan of Survey.
NOW THEREFORE, the Council of the Town of Aurora enacts as follows:
(1) That upon and after the passing of this Bylaw all that portion of
Engelhard Drive laid out and described in Schedule '~11 be and the
same is hereby closed and stopped up.
(2) All that part of the said Engelhard Drive hereinbefore described
and stopped up shall be sold to the adjoining owner, the Corporation
of the Town of AU1'ora. ·
(3) The Mayor and Deputy Clerk of the Corporation of the Town of Aurora
are hereby authorized to sign or execute such deeds or other
documents as may be necessary to effect conveyance of that part of
Engelhard Drive hereinbefore described and which has been stopped
up and closed.
