' • --b ' BY-LAW NUMBER 2483-82 OF THE MUNICIPAL CORPORATION OF THE TOWN OF AURORA BEING A BY-LAW TO AMEND BY-LAW NUMBER 1863 A RESTRICTED AREA BY-LAW WHEREAS it is deemed advisable to amend By-law Number 1863. NOW THEREFORE the Council of the Corporation of the Town of Aurora enacts as follows: 1. Notwithstanding the provisions of Section VIII-Zone Provisions-Parts 1, 2 & 3, the ground floor of the existing building on the lands shown in hatching on Schedule "A" attached hereto and forming part of this By-law may be used for a Nursery School. 2. For the purposes of this By-law a Nursery School shall mean: "A day nursery as defined by The Day Nurseries Act (RSO 1980) that enrolls children from 4 to 5 years of age for 1/2 day on more than one day in a week and for more than 8 consecutive weeks at a time." 3. The Clerk of the Town shall seek approval of this By- law by the Ontario Municipal Board for a period not exceeding two (2) years from the date of passage of this By-law pursuant to Section 39(10) of The Planning Act ( R. To amend By-law 1863 the Zoning By-law governing the urban portion of the Town of Aurora to permit the owner of the house existing on lot 10, Registered Plan 67 (53 Spruce Street) to use the ground floor of the building as a Nursery School providing half day instruction to children of Junior Kindergarten age. The owner has applied for a license from the Ministry of Health and Social Services. The only requirement not yet met is compliance with the Zoning By- law. The Fire Department and Health Authorities have issued approval. The owner of the house, a qualified primary teacher, intends to relocate the facility after two years of operation to a larger premises which is why the exemption is for a period of two years.
