BY-LAW NUMBER 2433/81 OF THE MUNICIPAL CORPORATION OF THE TOWN OF AURORA Being a By-law to adopt Amendment No.lS to the Official Plan of the Aurora Planning Area. The Council of the Corporation of the Town of Aurora in accordance with the provisions of Section 17(1) of The Planning Act enacts as follows: l. Amendment No. 19 to the Official Plan of the Aurora Planning Area, consisting of the attached explanatory text, is hereby adopted. 2. That the Municipal Corporation of the Town of Aurora make application to the Ministry of Housing for approval of said Amendment. 3. The Clerk is hereby authorized and empowered to make or cause to be made on behalf of this Corporation such application as may be necessary to the Ministry of Housing for approval of said Amendment and to execute under the Corporate Seal such documents as may be required for the above purposes. Read a first and second time this )I [i Read a third time and finally passed this 1981 Mayor day of ~ 1981 ££Pr j~ dayo~ /(1.:4/ /'·-· AMENDMENT NO. 19 TO THE OFFICIAL PLAN OF THE AURORA PLANNING AREA PART II: THE PREAMBLE 1. TITLE AND COMPONENTS This amendment comprising the text and schedule shall be known as Amendment #19 to the Official Plan of the Aurora Planning Area. 2. The Purpose The purpose of this amendment is to: (i) Amend the text of the Official Plan in Appendix "A" "AURORA WEST SECONDARY PLAN: Part VII "Servicing" to permit limited Suburban Residential Development on private wells under specified conditions. (ii) To change to land use designation from "Rural" to "Suburban Residential". 3. Location The subject lands are part of Lot 76, Concession 1, vJYS more particularly shown on Schedule "A" which forms part of this amendment. 4. BASIS OF THE AMENDMENT This Amendment has been enacted by Council in response to the following: (1) The subject lands comprise approximately 4 hectares (10 acres). The owner has applied for consent to sever the lands into three lots ranging from 1.2 hectares (3 acres) to 1.6 hectares (4 acres). A large estate type home is located on the most easterly part of the site. Under the present proposal 2 more houses could be accommodated on the property. (2) The subject lands were designated Suburban Residential by the AUrora West Secondary Plan. However, this property has not yet been approved by the Minister of Housing and therefore remains in a Rural category which discourages severances of this nature. ' ' (3) The lands to the West, North and East of the subject lands are designated Suburban Residential by the Official Plan by virtue of the Ontario Municipal Board having approved the Aurora West Secondary Plan insofar as it applied to these lands, by its order dated May 24, 1979. (4) The Suburban Residential category provides that servicing shall be by means of a municipal water system and private sewage disposal. (5) It could be some years before a water supply is available to service the subject lands. In vi.ew of the very large lots proposed and the rolling, tree covered terrain which limits the number of lots which could be created on the land, it is Council's intention that these lands be serviced by individual wells rather than a municipal water system. (6) When municipal water becomes available the owners could at their expense be connected to it. AMENDMENT NO. l9 TO THE OFFICIAL PLAN OF THE AURORA PLANNING AREA PART III: THE AMENDMENT 1. The Official Plan of the Aurora Planning Area is hereby amended by adding the following statement to Part VII Servicing of Appendix "A" -the Aurora West Secondary Plan. "Where in Council's opinion, municipal water supply will not be required, limited residential develop- ment will be permitted to proceed on the basis of individual wells, provided that all other policies of this plan are complied with and good planning principles are adhered to; and subject to the approval of the Medical Officer of Health." 2. Schedule "A" to the Official Plan of the Aurora Planning area is amended by changing the land use designation of the subject lands which are part of Lot 76, Concession 1, W.Y.S. more particularly shown on Schedule "A" attached hereto, from Rural to Suburban Residential. 3. Implementation Interpretation. Sections 10 and 11 of the Official Plan will apply to this Amendment.
