OF THE MUNICIPAL CORPORATION OF THE TOWN OF AURORA.
BEING A BY-LAW TO AMEND BY-LAW NUMBER 2213-78
A RESTRICTED AREA (ZONING BY-LAW)
WHEREAS it is deemed advisable to amend By-law Number 2213-
78'
NOW THEREFORE the Council of the Corporation of the Town of
Aurora enacts as follows:
1. Notwithstanding the provisions of Section 29.2.2
respecting minimum side yards, the minimum side yard
requirement for the lands shown in hatching on Schedule
"A" attached hereto and forming part of this By-law
shall be 7 metres.
2. For the purposes of this By-law the provisions of
Section 6.23 "Effect of Expropriation" shall be deemed
to include a road widening dedicated to a public authority.
3. All other provisions of By-law 2213-78 shall apply to
the subject lands.
4. No part of this By-law will come into force until the
provisions of The Planning Act have been complied with
but subject to such provisions the by-law will take
effect from the day of passing thereof.

By-law ,11 o 1 has the following purpose and effect.
To amend By-law 2213-78 the zoning by-law governing the Town
of Aurora to reduce the side yard requirement from 9 metres
(29 .52 feet) to 7 metres (22. 96 feet). The owner of the
subject lands proposes to sever the 20 hectare (50 acre)
parcel into two parcels each having approximately 10 hectare
(25 acres) and each occupied by a presently existing detached
dwelling unit. The proposed lots would comply which the
minimum lot size and frontage requirements set out in the
by-law. However, in order to comply with the minimum frontage
and minimum area requirements the side lot line must be
located less than the required 9 metres from the existing
house on the more southerly lot and the by-law must therefore
be amended.
The Regional Engineering Department has requested that a 27
foot wide road widening be dedicated to the Region of .York.
By-law 2213-78 provides that where a lot is made smaller
than the minimum requirement as a result of an expropriation,
the lot may still be used for the permitted uses. The by-
law does not, however, provide this relief where a road
widening is dedicated to a public authority. This by-law
would include a dedication to a public authority of a road
widening in the exception provided for undersized lots
resulting from expropriation as the provision applies to the
subject lands.
The metric dimension shown on Schedule "A" are equivalent to
imperial limits as follows:
