BYLAW - Amend 2142 77 - 19780814 - 220278/" BY-LAW NUMBER 2202 -78 OF THE MUNICIPAL CORPORATION OF THE TOWN OF AURORA. BEING A BY-LAW TO AMEND BY-LAW NUMBER 2142-77 (AS AMENDED BY BY-LAW 2187-78) A RESTRICTED AREA (ZONING) BY-LAW Whereas it is deemed advisable to amend By-law 2142"77 (as amended by By-law 2187-78). NOW THEREFORE the Council of the Corporation of the Town of Aurora enacts as follows: 1. That a new paragraph be added to Section 5.1.3(2) of By-law 2142-77 (as amended by By-law 2187-78) to provide as follows: "Notwithstanding the provisions of Section 5.1.3(2) respecting minimum set back from centre line of original allowance for road and minimum rear yard, a d.welling may be constructed on the lands shown in dark outline on Schedule "A" attached hereto and forming part of this By-law provided that all buildings and structures are located not less that 23.5 metres from the centre line of orizinal allowance for road and not less than 4 metres from the rear lot line." 2. No part of this By-law will come into force without Ontario Municipal Board approval, but subject to such approval, the By-law will take effect from the day of passing thereof. /7d READ A ~ST TIME THIS ...... MAYOR CLERK READ A THIRD TIME AND FINALLY PASSED ····:!?. ... ~~ ~ MAYOR EXPLANATORY NOTE RE: BY-LAW NUMBER 2202 ...;78 This By-law proposes to amend By-law Number 2142-77, the Zoning By-law (as amended by By-law Number 2187-78) as it applies to an existing lot created in the late 1800's and formerly occupied by a church. By-law 2187-78 amended By-law 2142-77 to permit the erection of a single family dwelling on existing lots of record and to reduce the side yard requirement from 9.144 metres (30 feet) to 3.048 metres (10 feet) on such lots. The subject lot has a depth of only 27.32 metres (86. 36 feet) and therefore the front yard requirement of 33.528 metres (110 feet) from the centre line of the original road allowance and the rear yard requirement of 22.86 metres (75 feet) cannot be met. This By- law would therefore amend the set back from centre line and the rear yard requirement as the~ apply to the lands in question to allow the applicant to construct a single family dwelling not less than 23.5 metres (77.1 feet) from the centre line of the original road allowance and not less than 4 metres (13.12 feet) from the rear lot line.
