BY -LAW NUMBER 2128-77 OF THE MUNICIPAL CORPORATION OF THE TOWN OF AURORA BEING A BY~LAW TO ADOPT SPECIFICATIONS AND PROCEDURES FOR RESTORATION OF UTILITY CUTS ON ROAD ALLOWANCES. WHEREAS the Municipal Council of the Town of Aurora deems it expedient to pass a By-Law for the aforesaid purposes; NOW THEREFORE the Municipal Council of. the Corporation of the Town of Aurora enacts as follows: 1. That all applications for a utility or road excavation shall be completed on the enclosed form and in accordance with this attach- ed Terms and Conditions herein referred to as Schedule "A" and filed with the Town Superintendent. 2. That the specifications set forth in Schedule "B" attached hereto, entitled Specifications For Restoration of Utility Cuts on Road Allowance be and the same is hereby approved and adopted. 3. That this By-Law shall be administered by the Town Superintendent of the Town of Aurora. 4. That this By-Law shall tome into force on finally passing thereof. '·" SCHEDULE "A" Terms and Conditions For the Restoration of Town Road Allowances ,,~,pplication And Permit For Road Allowance Excavation: Permit application is to be made by an authorized representative of the Utility Company or Contractor {whenever said Contractor is not engaged in work or acting as an agent on behalf of the Utility Company) Permits will not be issued withlilut the signature of an employee who is in an authorized position to sign on behalf of his or her employer. Emergency Work: When an emergency situation necessitates excavation within a Town road allowance and a formal application cannot be made as a result of the working hours kept by the Works Department, said permit is to be obtained on the first working day following the excavation. Specifications: Specifications have been sent to all Utility Companies. Contractors are to contact the Aurora Works Department, 9 Scanlon Court where a complete set of specifications are available for inspection. Restoration work is to be done in accordance with applicable M.T.C.' specifications. "Measurement For Payment" and "Basis of Payment" sections of said specifications 'I!Xe to be ignored • . laintenance Period: '-"/-;~ The Utility Company or Contractor is responsible for the maintenance of the restoration for a period of one calendar year following the completion of said restoration. Should repairs become necessary, it is agreed that the Town Super- intendent shall engage Works Department forces to make the necessary repairs, the cost of which will be absorbed by the Utility Company or Contractor. , This does not relieve the Utility Company or Contractor of their liability for damages . resulting from the condition of the restoration. Utility Location: The Utility Company or Contractor shall be responsible in arranging for all utility and service stake-outs. Work· shall be conducted' in a fashion which will result in minimai inconvenience and interference to the public. The Utility Company or 'contractor shall arrange for all. signs, delineators, bardeades, lanterns, safety cones, flagmen etc. necessary in maintaining saf€1 passage and control of both vehi.cular and pedestrian traffic and sai.d costs are to be absorbed by the Utility Company or Contractor.
