OF THE }IDNICIPAL CORPORATION OF THE TOWN OF AURORA
A BY-LAW TO AMEND BY-LAW NUMBER 1863, BEING A RESTRICTED AREA
(ZONING) BY-LAW AND TO REPEAL BY-LAW 2023-74
WHEREAS it is deemed advisable to amend By-Law Number 1863.
AND WHEREAS By-Law 2023-74 no longer accurately expresses the
intentions of Council of the Corporation, and it has been resolved
to repeal By-Law 2023-74.
NOW THEREFORE the Council of the Corporation of the Town of Aurora
enacts as follows:
1. That By-Law 2023-74 finally passed September 16th, 1974 by
the Council of the Corporation and approved by the Ontario
Municipal Board on May 28th, 1975 is hereby repealed.
2. Notwithstanding the provisions of Schedule 11 B", Performance
Standards 9. the lands shown in hatching on Schedule "X" to
this By-Law may be used for the erection of an apartment
building having three storeys at the Yonge Street frontage
and four storeys to the rear of the lot.
3. All other provisions of By-Law 1863 will apply.
4. No part of this By-Law shall come into force without
Ontario Municipal Board approval, but subject to such
approval, the By-Law shall take effect from the day of
passing thereof.

EXPLANATORY NOTE FOR
BY-LAW NUMBER BY-LAW NUMBER 2123-77
The subject lands are presently zoned for Apartment
Residential uses with Performance Standards of
9.20.30.43 which would permit 40 units to the acre
with a minimum number of floors of 6, minimum front
yards of one-half of the height of the building but
in no case less than 30 feet from the. street line,
and minimum side yards of one-half of the building
height and in no case less than 20 feet.
Minimum floor areas are as follows:
-Bachelor
-One Bedroom
-Two Bedrooms
-Three Bedrooms
450 square feet
575 square feet
700 square feet
825 square feet
The proposed change in zoning would reduce the mini-
mum required height for the permitted apartment re-
sidential use on the subject lands from 6 storeys to
3 storeys at the front of the building and 4 storeys
at the rear of the building.
The purpose of this change is to protect an adjacent
house, which due to its age and design is felt to be
of historical significance. It is felt that a low•
ris'e apartment building which this By-law would per-
mit would be much more in character with the adjacent
historic building then would a 6 storey building
which is permitted under the 'present zoning. All
other requirements of By-law Number 1863 can be comp-
lied with on the subject site.
The Town of Aurora intends to enter into a site plan
agreement with the applicant in which building design,
landscaping, grading of the land, etc., will be stip-
ulated.
