OF THE MUNICIPAL CORPORATION OF THE TOWN OF AURORA
A BY-LAW TO PROVIDE FOR THE ESTABLISHMENT AND REGULATIONS OF A
VO.LUNTEER FIRE DEPARTMENT IN THE TOWN OF AURORA.
THE MUNICIPAL COUNCIL OF THE TOWN OF AURORA ENACTS AS FOLLOWS:
1. A Municipal Fire Department is hereby established under the
authority of the Municipal Act to be known as the Aurora Volunteer
Fire Department, hereinafter called "The Brigade".
2. The Brigade shall consist of a full time Chief, and volunteers
consisting of one Deputy Chief, two Captains, two Lieutenants, and not
less than sixteen fire fighters.
3. Every me.mber of the Brigade shall be a physically fit resident
of the Town of Aurora of good reputation, and eighteen years of age or
over, and not more than 65 years of age for the Chief, and not more
than 60 years of age for fire fighters. In exceptional circumstances,
mutually agreed between the Corporation of the Town of Aurora and the
Chief, a year by year extension may be granted by the Municipal
Corporation to the Chief until age 70 when retirement is mandatory.
Every member of the Brigade shall be required to pass a medical
examination, including an EGG annually, ·No person over the age of
40 years shall be permitted to join the Brigade, and all new members
shall be required to pass a medical examination prior to admittance.
4. (1) The Chief shall be appointed by By-Law passed by the
Council and shall hold office until such By-Law is rescinded. When
the office of Chief is to be filled, the Public Safety Committee of
Council shall recommend the name of a person for the position.
(2) All full-time officers and fire fighters shall be
appointed by the Council upon the recommendation of the Chief and
shall serve a probationary period of three .months before permanent
appointment.
(3) Subject to the provisions of this By-Law, all officers,
who are volunteers, shall be appointed by the Chief.
(4) Any application for membership in the Brigade as a
volunteer fire fighter, shall be considered
Chief after consultation with the Officers;
and decided upon by the

serve a probationary period of six months before final acceptance.
5-(1) The Chief may suspend any officer or fire fighter for
insubordination, inefficiency, gross misconduct, or repeated failure
to attend practices or fires.
(2) If such officer or fire fighter is a full-time employee,
the Fire Chief shall report the offence and his recommendation to the
Council who shall take such action as it may deem advisable.

5. (3) If such officer or fire fighter is a volunteer, the
Chief may reduce in rank or dis.miss him, and shall report thereon
to the Clerk-Administrator.
6. The annual cost of operating the department shall be included
in the annual estimates of the municipality and the clerk shall notify
the Chief at least two weeks prior to the date on which the estimates
are to be considered, and the Chief shall submit within one week
thereafter his estimates for the expenditures necessary d~ing the ------1
forthcoming year for the operating and maintenance of the depart.ment.
7. The estimates, as submitted by the Chief, shall be in the
form required by the Treasurer and shall include the amounts to be
paid for;

the services of the fire fighters;
uniforms, clothing allowances and personal equipment
for the fire fighters;
office supplies and equipment and clerical assistance;
The Workmen's Compensation Act or benefit plan approved
by the Workmen's Compensation Board;
liability and fire insurance premiums;
contributions to any pension plan for full-time fire
fighters who are members of the department;
membership in and expenses of representatives attending
meetings of associations~ Fire Marshalls, Fire Chiefs
or fire fighters or any fire college or fire school
conducted by the Fire Marshall;
the purchase of new fire apparatus and fire fighting
equipment;
the purchase of new fire alarm and communications
systems and equipment;
the normal operation, maintenance and repair of fire
apparatus, fire fighting equipment and fire alarm and
communications system and equipment;
the normal operation, maintenance and repair of the fire
hall;
the cost of altering, re-building or constructing any
fire hall;
any amount charged to the fire department for hydrant
rentals or water supplies;
any other items charged to the fire department -and
the cleaning of dress uniforms not to exceed four times
per year.
8. Salaries and allowances to the Officers and fire fighters shall
be as determined by the Council from time to time
9. The Brigade shall not respond to any fire calls outside the
limits of the municipality, except,
(a) with respect to any fire which in the opinion of the Chief
threatens any property within the .municipality;
(b) from a municipality with which an agreement has been
entered into to provide fire protection on a mutual aid basis or
at an annual rate or at a fee per call; or
(c) where an agreement to provide fire protection on an annual
rate or fee per call basis has been entered into with any company,
organization or person whose property is situated outside the
municipal limits and distant not more than fifteen miles therefrom.

10. (1) the Chief shall have cbarge of the conduct and general
operation of the department, including fighting a fire, responding
to a fire alarm, at drills or practices, and the care and maintenance
of the fire hall and all apparatus, equipment and supplies.
(2) the Chief shall,
(a) maintain proper decorum, discipline and efficiency of the
department at fires, alarms and practices and in the
discharge of all department duties in so far as they have
a bearing on the efficiency of the department or the care
and maintenance of the fire hall, apparatus, equipment and
supplies;
(b) regularly inspect for fire hazards all manufacturing and
mercantile establishments, churches, schools, institutions
and public buildings and places of public assembly, and on
request inspect residences, and designate any officer or
fire fighter as fire prevention inspector, to assist in
such duties; ·
(c) maintain a book to record the attendance of members of the
department at fires and practices, the particulars of
every fire call and every fire reported to the department and
the apparatus, equipment and supplies used for each fire call,
and any breakages, shortages or deficiencies in the
apparatus, equipment and supplies, and any other information
that may be required from time to time by the Council;
(d) submit a report to the Council annually, or more often if
requested, outlining the activities of the department and
the losses in life and property suffered by fire;
(e) submit a report to the Council immediately of any injuries
to members of the department and any breakages, shortages or
deficiencies in the apparatus, equipment and supplies, and
any occurrence requiring the suspension or dismissal of any
.member of the department; and
(f) report promptly all fires to the Fire Marshall of Ontario
on the printed forms supplied for such purpose and otherwise
comply with the provisions of the Fire Marshalls Act and
Regulations thereunder and other Provincial laws for which
the Fire Chief is an enforcing officer.
11. All officers shall carry out the instructions of their senior
officers.
12. The fire fighters shall respond promptly to all fire alarms,
attend all practices as often as possible, and carry out the
instructions of the officers.
13. The Brigade shall meet at least once a month for practice
and instruction in the use of all apparatus, equipment and supplies
of the depart.ment and in the principles of fire prevention and fire
protection.
14. The officer in charge of the Brigade at any fire may cause
any fence or any out-structure to be removed or torn down, if such
removal or tearing down appears necessary to prevent the spread of fire.
15. (1) The members of the Brigade may organize for social purposes
and other purposes intended to further the interest and welfare of the
Brigade and the members thereof.
(2) The Brigade may at any time have the use of the fire hall
and, subject to the approval of the Council, the council chambers or
Municipal Hall at any convenient time for business or social functions.

(3) No rule or regulation of any such social organization
shall in any way limit the authority of the Fire Chief in fire
fighting and at practices.
16. No person shall impede, molest, interfere with or
hinder any officer or fire fighter in the discharge of his duties at
a fire, in responding to a fire alarm or at a practice, and no person
shall damage the apparatus, equipment or supplies, and no person shall
put to any use, not authorized by the Chief or officers in charge of
any apparatus, equipment and supplies.
17. Any person contravening any of the provisions of this By-Law
shall, upon conviction therefor, be liable to a fine not less than
$10.00 and not exceeding $50.00 exclusive of costs or to imprisonment
for any term not exceeding twenty-one days, or to both such fine and
imprisonment.
18. By-Law Number 1303 is hereby repealed and, in the event that
the provisions of any other By-Law or By-Laws conflict with the
provisions of this By-Law, the provisions of this By-Law shall govern.
