BYLAW - ZBA John West Way Wellington StE - 20130813 - 554413THE CORPORATION OF THE TOWN OF AURORA By-law Number 5544-13 BEING A BY-LAW to amend Zoning By-law Number 2213-78, as amended (John West Way and Wellington Street East, File: D14-16-05). WHEREAS section 34 of the Planning Act, R.S.O. 1990, c. P.13, as amended, provides that the councils of local municipalities may pass zoning by-laws; AND WHEREAS the Council of The Corporation of the Town of Aurora (the "Town") enacted By-law Number 2213-78, including amendments thereto (the "Zoning By- law"); AND WHEREAS the Council of the Town enacted By-law Number 3206-90, which amended the Zoning By-law to replace the "Rural General (RU) Zone" and "Environmental Protection (EP) Zone" categories applying to certain lands located west of Bayview Avenue between St. John's Sideroad and Wellington Street East with multiple site specific zones including "Office Commercial (C6) Zone" with respect to a portion of the lands therein; AND WHEREAS the Council of the Town deems it necessary and expedient to further amend the Zoning By-law; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF AURORA HEREBY ENACTS AS FOLLOWS: 1. THAT the Zoning By-law be and is hereby amended to replace the "Office Commercial (C6) Zone" zoning category applying to the lands identified on Schedule "A" attached hereto and forming part of this By-law with "Shopping Centre Commercial (C4-24) Exception Zone" and "Environmental Protection (EP) Zone". 2. THAT the Zoning By-law be and is hereby amended to add the following: "23.24 SHOPPING CENTRE COMMERCIAL (C4-24) EXCEPTION ZONE Notwithstanding the provisions of Section 23, the following provisions shall apply: 23.24.1 Uses Permitted retail stores and convenience retail stores (provided that the combined gross floor area of all retail uses does not exceed forty percent (40%) of the total gross floor area) bake shop, special By-law Number 5544-13 Page 2 of 3 - banks or financial establishments - business and professional offices - clinics - dry cleaning establishments - medical and dental laboratories - personal service shops - restaurants - restaurants, take-out 23.24.2 Zone Requirements 23.24.2.1 Notwithstanding the provisions of Section 3.78, the southern lot line adjacent to Wellington Street East shall be deemed to be the front lot line. 23.24.2.2 Lot Specifications (minimum) Lot Area 8,800 square metres Lot Frontage 70.0 metres 23.24.2.3 Siting Specifications (minimum) Front Yard 2.0 metres Rear Yard 10.0 metres Interior Side Yard 10.0 metres Exterior Side Yard 2.0 metres 23.24.2.4 Building Specifications Lot Coverage (minimum) 14.0 percent Height (maximum) 5 storeys 23.24.2.5 Parking Requirements Notwithstanding the provisions of Section 6.26, a minimum of 3.5 parking spaces and a maximum of 4.5 parking spaces per 100 square metres of gross floor area shall be provided." 3. THAT all other terms, provisions, and existing amendments of the Zoning By- law remain the same. 4. THAT this By-law shall come into full force subject to compliance with the provisions of the Planning Act, R.S.O. 1990, c. P. 13, as amended, and subject to compliance with such provisions, this By-law will take effect from the date of final passage hereof. READ A FIRST AND SECOND TIME THIS 13TH DAY OF AUGUST, 2013. CH, TOWN CLERK By-law Number 5544-13 Page 3 of 3 Explanatory Note Re: Zoning By-law Number 5544-13 By-law Number 5544-13 has the following purpose and effect: To amend By-law Number 2213-78, as amended, being the Zoning By-law in effect in the Town of Aurora, to rezone the subject lands from "Office Commercial (C6) Zone" to "Shopping Centre Commercial (C4-24) Exception Zone" and "Environmental Protection (EP) Zone". The rezoning will permit a one (1) storey 1,255m2 multi -unit retail plaza.
