BYLAW - Adopt OPA 4 - 20130813 - 554313THE CORPORATION OF THE TOWN OF AURORA By-law Number 5543-93 BEING A BY-LAW to adopt Official Plan Amendment No. 4. WHEREAS on September 28, 2010, the Council of The Corporation of the Town of Aurora (hereinafter the "Town") enacted By-law Number 5285-10, being the new Official Plan for the Town, including amendments thereto (hereinafter the "Official Plan"); AND WHEREAS authority is given to Council pursuant to the Planning Act, R.S.O. 1990, c. P.13, as amended, to pass a by-law amending the Official Plan; AND WHEREAS the Town deems it necessary and expedient to further amend the Official Plan; NOW THEREFORE THE TOWN HEREBY ENACTS AS FOLLOWS: 1. THAT Official Plan Amendment No. 4 attached hereto and forming part of this By-law is hereby adopted. 2. THAT all other terms, provisions, and existing amendments of the Official Plan remain the same. 3. THAT this By-law shall come into force subject to compliance with the provisions of the Planning Act, R.S.O. 1990, c. P.13, as amended. Introduction This part of the Official Plan Amendment No. 4 (hereinafter the “Amendment”) entitled Part I – The Preamble, explains the purpose and location of this Amendment, and provides an overview of the reasons for it. It is for explanatory purposes only and does not form part of the Amendment. 2. Purpose of the Amendment The purpose of this Amendment is to change the land use designation from “Promenade General” to “Promenade General Special”. The “Special” provisions will allow a one (1) storey multi-unit retail plaza development having a gross floor area of 1,255m2. 3. Location The lands affected by this Amendment are located on the north-east corner of the intersection of John West Way and Wellington Street East and have frontage along the east side of John West Way and the north side of Wellington Street East. The lands have a lot area of approximately 0.89 hectares (2.20 acres) and are legally described as Part Lot 81, Concession 1, EYS, Part 4, Plan 65R-13645, Town of Aurora, Regional Municipality of York (hereinafter the “Subject Lands”). 4. Basis of the Amendment The basis of the Amendment is as follows: 4.1 Applications for amendments to the Town’s Official Plan and Zoning By-law were originally submitted in October, 2005 to permit the construction of a seven (7) storey residential condominium building consisting of 184 dwelling units. 4.2 Applications for amendments to the Town’s Official Plan and Zoning By-law were revised and re-submitted in June, 2011 to permit the construction of a one (1) storey multi-unit retail commercial plaza having a gross floor area of 1,255m2. Page 5 4.3 A Public Planning Meeting was held by the Town on September 26, 2011 to obtain input from members of the public. 4.4 Subsequent to the Official Plan amendment submitted in October, 2005, the Town undertook an Official Plan review and a By-law to approve a new Official Plan was enacted by Council on September 28, 2010 and approved by The Regional Municipality of York on June 28, 2012. The Town’s ‘new’ Official Plan came into force on August 14, 2012. 4.5 The Promenade General designation permits a broad range of uses such as commercial uses including retail stores. This list of permitted uses will continue to apply to the Subject Lands as a result of this Amendment. The Promenade General designation parking policies will also continue to apply to the Subject Lands as a result of this Amendment. 4.6 The implementing Zoning By-law will incorporate appropriate development provisions and performance standards for the development of the Subject Lands. 4.7 It is not feasible for the Subject Lands to fully comply with the strict development provisions of the Promenade General designation built-form standards due to the locational context of the Subject Lands being at a key corner intersection within a Lake Simcoe Region Conservation Authority fill regulated area; and directly adjacent to Environmental Protection lands at the westerly terminus of the Promenade General designation limit. 4.8 Appropriate development of the Subject Lands for commercial purposes can be achieved through the detailed review and urban design evaluation of the Town’s Site Plan control process as envisioned by the Promenade policies of the Official Plan. This will be ensured through the Town Council’s review and approval of the final Site Plan. 4.9 The Promenade General “Special” policies of the Official Plan are compatible with the existing uses and Official Plan land use designations within the neighbourhood. Page 6 PART II – THE AMENDMENT 1. Introduction All of this part of the document entitled Part II – The Amendment, consisting of the following text, constitutes Amendment No. 4 to the Official Plan. 2. Details of the Amendment The Official Plan is hereby amended as follows: Item (1): To re-designate the Subject Lands from “Promenade General” to “Promenade General Special”, as shown on Schedule “A” – Land Use Plan, attached hereto and forming part of this Amendment. Item (2): The following site specific policies shall apply to the Subject Lands shown on Schedule “H”, Site Specific Policy Areas, attached hereto and forming part of this Amendment: The Promenade General development policies as outlined in Section 11.6.2 of the Official Plan shall not apply to the Subject Lands. The development policies and performance standards applying to the Subject Lands will be contained in the implementing Zoning By-law based on the location, context, proximity to the environmental lands, and the Town’s urban design principles. Item (3): “Schedule “H”, Site Specific Policy Areas being part of the Town of Aurora Official Plan, is amended by adding site specific policy area 39. Item (4): Section 16 of the Town of Aurora Official Plan, as amended, is hereby amended by adding the “Details of the Amendment – Official Plan Amendment No. 4”. 3. Implementation and Interpretation This Amendment has been considered in accordance with the provisions of the Official Plan. The implementation and interpretation of this Amendment shall be in accordance with the respective policies of the Official Plan, the Town’s Zoning By- law Number 2213-78, as amended, and related agreements as required.
