A BY-LAW TO LICENSE, REGULATE AND GOVERN LODGING HOUSES
AND THE KEEPERS OF LODGING HOUSES AND FOR REVOKING OF ANY
LICENSE.
WHEREAS Section 388 (1) Subsection 127 provides
that. Councils of local.MunicipalitieS may pass a By~Law
for licensing, regulating and governing lodging houses
and the keepers of lodging houses and for revoking any
such license.
AND WHEREAS the Council of the Town of Aurora deems
""' it,advisable to pass a By-Law to license, regulate and
govern·lodging'houses and the keepers of lodging houses
in the Town of Aurora and for revoking any such license.
NOW THEREFORE THE MUNICIPAL COUNCIL OF THE CORPOR-
ATION OF THE TOWN OF AURORA. ENACTS AS FOLLOWS:
1. In this By-Law,
(a) Lodging house means any house or other building or
portion thereof in which perscns are harboured, received
or lodged for hire but does not include an hotel, hospital,
home for the young or aged or institution, provided the
hotel, hospital, home or institution is licensed, approved
or supervised under any general or sp~cial Act.
(b) Keeper means the person for the time being licensed

to keep a lodging house.
(c) Board shall mean the York County Health Unit.
(d) Building shall mean any house, building or similar
structure, the whole or any portion of which is used or
intended for use for lodging persons
and premises appurtenant thereto and
therein with the land ~

fences or erections thereon or therein.
2. No person shall, within the limits of the Town of
Aurora, carry on a lodging house or be the keeper of such

a lodging house, unless or until he shall procure a license _A,( l f{fY
therefor from the Board and every person so licensed shall

be subject to the provisions of this by-law.
3. There shall be taken out by every person who keeps,
carries on, operates or controls a lodging house, a license

authorizing him so to do for which said license the person
obtaining same shall pay at the time of taking out such
license a fee a~.cording to the scale of fees set out in
schedule "A" to this by-law.
~. Each license shall be issued in respect of a location
as set out in the license and the person licensed under this " e(j} ·
by-law shall not use any such license for a different location/"
5. Each 1te·ense shall be issued in respect of a definite
number of persons and the person licensed shall not permit
any greater number of persons than the number named in the
license to be harboured, received or lodged for hire at the
location in respect of which the license was issued.
6. The keeper shall not permit any lodger to occupy for
'·· sleeping purposes any space in a building used a lobby,
hallway, closet, bathroom, stairway, kitchen, nor any room
having a floor spa!<e of less than fifty square feet, nor
room the floor of which is more than four feet below the
finished gzade of the land adjo~ning the building.

7. No room used for sleeping purposes shall be occupied ~
by more than one person for wa~h fifty square feet of the ~' ·
floor area thereof.
8. The keeper shall not permit any person in such lodging
house to be used for sleeping purposes unless it contains a
window opening directly to the outside air, which window shall
be glazed, shall not be less than 10 per centum of the floor
are of the room in size, shall be provided with suitable hard-~
ware and be capable of being opened to the extent of not les~'i/
than 5 per centum of the floor area of such room.
9. The keeper shall regulate and control the lodging
house so that it shall not be a nuisance to the o'mers and
occupants of premises in the vicinity thereof, and shall take
such action as may be necessary to prevent any noise, distur-
bance or trespass by lodgers of the lodging house which might .~13
interfere with the quiet and peaceful enjoyment of such ~ ·
premises.

10. For the purpose of determining the number of persons
who may be r~ceived into a lodging house or who may occupy any
room therein for sleeping p. urposes, two children under tan ,~
years of age shall be counted as one person. ~1
11. The keeper shall maintain the lodging house in a
thoroughly clean, safe and sanitary condition, and without
limiting the generality of the foregoing, he shall, -
(a) Keep the cellar of the building well drained and
ventilated.
(b) Keep all buildings weatherproof, free from dampness,
adequately heated, and keep all heating equipment in good
repair.
(c) Keep all parts of the building free from rubbish, gar-
bage, ashes, flammable materials and other debris.
(d) In lodging houses where meals are served, maintain
adequate kitchen equipment and facilities to ensure the pro-
per preparation and protection of food.
(e) Take whatever steps are necessary to keep
ings free from vermin, insects and pests.

Every applicant for a license to keep a lodging house
shall file with the license inspector a written application which
shall contain the fmllowing informatiou;
(a) Name and address of the applicant.
(b) The location of the premises for which a license is
sought.
(c) The class or classes of lodging house which it is pro-
posed will be operated.
(d) The number of bed rooms available for lodgers.
(e) The naximun number of persons which the applicant pro-
poses to accommodate at one time.
(f) The number of bath tubs or showers, wash basins and
water closets in the premises s:>ught to be licensed. ,;· ,/
(g) Such other information as the Board from time to time
may require.
lj. The license inspector shall forthwith forward a copy of
each application to the Medical Officer of Health who shall
obtain reports from such other officials as he considers advisable,

a nd shail forw~rd his report on each application to the
Secretary of the Board.
1~. The Board shall ha~e the right to specify the kind of
license

and the n~ber of persons which it may consider ad~is-~
accommodate in the building in respect or which th~/~
is issued.
The Medical Officer of Health, the Commissioner of
Buildings or any other employee of the c·orporation required to
administer or enforce the provsions of this by-law are hereby
authorized to enter a lodging house at all reasonable times for
the purpose of inspecting same and to ascertain whether the
regulations and provisions herein contained are being or have
been complied with and it shall be an offence for any
licensed under this by-law to prevent or obstruct any
person ;}.

16. In every lodging house, the license shall be posted/~
in a conspicuous place in the lower hallway.
17. A person licensed under this by-law may transfer the
license or a part intereSit in any license, but the transferee
shall make an application in every respect the same as that re-
quired to obtain a license, and the powers, conditions, require-
ments, and procedure relating to the granting, revocation and ~~
refusal of licenses shall apply to such applic~tion and the ~I'
transferee.
18. Any person who acquires the interest of or part of the
interest of any pason licensed under this by-law and shall
carry on or continue to operate a lodging house without having
first obtained a transfer or a new license shall be guilty·:~~~
an offence against this by-law. ~I',
19. The fee payable in respect of the transfer of any
license or part interest therein shall be two dollars ($2,00) ~·
and no license shall be transfereed more than once during t~\'
currency thereof.
20. The Board may at any time revoke any license issued
under this by-law, and notice thereof shall be given by the
Board by registered letter mailed to the keeper at the address
in respect of which the license applied. yrl~

21. Every person who shall within the Town of Aurora con-
duct, own, operate, engage in or carry on a lodging house
without being the holder of alicense therefor, shall be liable
to the Town of Aurora for the amount of the fee payable under
the pro~ions of this by-law in respect thereof, and the same

shall be a debt due to the Town of Aurora and shall be reaover-
22. Each license shall be in force for one year from the .

23. Any person convicted of a breach of any of the provisions
of this by-law shall forfeit and pay at the discretion of the "~. /
convicting magistrate a penalty not exceeding the sum of ~~

24. In this by-law words importing the singular number or
masculine gender only shall include more persons, parties or ~
things of the same kind than one, and females as well as male~
and the converse.
25. This by-law shall come into force and
