BYLAW - Acquire Lands Municipal Purposes DJ Smith 45 Industrial Pkwy S - 20130625 - 551713THE CORPORATION OF THE TOWN OF AURORA By-law Number 5517-13 BEING A BY-LAW to acquire lands for municipal purposes (Daniel Joseph Smith - 45 Industrial Parkway South). WHEREAS Section 5(3) of the Municipal Act, 2001, S.O. 2001, c.25, as amended (hereinafter the "Act') states that a municipal power, including a municipality's capacity, rights, powers and privileges under section 9 of the Act, shall be exercised by by-law unless the municipality is specifically authorized to do otherwise; AND WHEREAS The Corporation of the Town of Aurora (hereinafter the "Town") deems it necessary and expedient to acquire for municipal road widening purposes the lands described on Schedule "A" attached hereto and forming part of this By-law (hereinafter the "Lands"); AND WHEREAS the Town and Daniel Joseph Smith entered into an Offer to Sell Agreement dated May 29, 2013, respecting the Town's purchase of the Lands (hereinafter the "Offer"), which Offer is conditional on the Town's enactment of the applicable by-law to acquire the Lands; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF AURORA ENACTS AS FOLLOWS: THAT the purchase of the Lands for municipal road widening purposes be approved in accordance with the recommendations set out in Closed Session Report No. IES13-034 as considered by General Committee on May 21, 2013, and subsequently adopted by Council on May 28, 2013. 2. THAT the Mayor and Clerk be authorized to execute all documents and ancillary agreements as may be required to give effect to the purchase of the Lands. 3. THAT the provisions of this By-law shall come into full force and effect upon final passage hereof. READ A FIRST AND SECOND TIME THIS 25TH DAY OF JUNE, 2013.
