BEING A BY-LAW to
amend Zoning By-law
Number 2213-78, as
amended (15441 Yonge
Street, File: D14-13-12).
WHEREAS section 34 of the Planning Act, R.S.O. 1990, c. P.13, as amended,
provides that the councils of local municipalities may pass zoning by-laws;
AND WHEREAS the Council of The Corporation of the Town of Aurora (the "Town")
enacted By-law Number 2213-78, including amendments thereto (the "Zoning By-
law");
AND WHEREAS the Council of the Town deems it necessary and expedient to
further amend the Zoning By-law;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
AURORA HEREBY ENACTS AS FOLLOWS:
1. THAT the Zoning By-law be and is hereby amended to replace the "Special
Mixed Density Residential (R5) Zone" zoning category applying to the lands
shown in hatching on Schedule "A" attached hereto and forming part of this
By-law with "Special Mixed Density Residential (R5-39) Exception Zone".
2. THAT the Zoning By-law be and is hereby amended to add the following:
"14.3.39 SPECIAL MIXED DENSITY RESIDENTIAL (115-39)
EXCEPTION ZONE
14.3.39.1 Uses Permitted
In addition to the uses permitted in Section 14.1, the existing
building on the lands zoned R5-39 on Schedule "A" may also be
used for business and professional offices.
14.3.39.2 Zone Requirements
14.3.39.2.1 Lot Specifications
Lot Area (minimum) 550 square metres
Lot Frontage (minimum) 15.0 metres
14.3.39.2.2 Siting Specifications
Front Yard (minimum) 4.0 metres
Rear Yard (minimum) 7.5 metres
Interior Side Yard (minimum) 2.0 metres

Notwithstanding the provisions of Section 6.48.1, and any other
provisions to the contrary, the' front porch shall be allowed to
encroach into the Front Yard 2.6 metres and be located a
minimum of 1.6 metres from the front lot line; and the porch
steps shall be allowed to encroach into the Front Yard 3.8
metres and located a minimum of 0.2 metres from the front lot
line.
14.3.39.2.3 Building Specifications
In accordance with the provisions of Section 11.2.3 hereof.
14.3.39.2.4 Parking
Notwithstanding the provisions of Section 6.26.1.4, and any
other provisions to the contrary, a total of 7 parking spaces shall
be provided. The provisions of Sections 6.27.2, 6.27.3 and
6.27.8 (f) shall not apply.
14.3.39.2.5 Ingress and Egress
Notwithstanding the provisions of Section 6.27.8 (a), and any
other provisions to the contrary, ingress and egress to and from
required parking spaces and areas shall be provided by means
of unobstructed driveways or passage ways at 3.9 metres but
not more than 9 metres in width.
14.3.39.2.6 Buffer Strip
i) Notwithstanding the provisions of Section 6.31, and any
other provisions to the contrary, a minimum buffer strip of
Nil shall be provided along the northerly and southerly lot
lines and no fencing or berming shall be required.
ii) A minimum buffer strip of 1.0 metre and a 1.5 metre high
wood fence shall be provided along the easterly lot line,
and no grassed strip or berming shall be required."
3. THAT all other terms, provisions, and existing amendments of the Zoning By-
law remain the same.
4. THAT this By-law shall come into full force subject to compliance with the
provisions of the Planning Act, R.S.O. 1990, c. P. 13, as amended, and
subject to compliance with such provisions, this By-law will take effect from
the date of final passage hereof.

Explanatory Note
Re: Zoning By-law Number 5511-13
By-law Number 5511-13 has the following purpose and effect:
To amend By-law Number 2213-78, as amended, being the Zoning By-law in effect
in the Town of Aurora, to rezone the subject lands from "Special Mixed Density
Residential (R5) Zone" to "Special Mixed Density Residential (R5-39) Exception
Zone".
The rezoning will permit business and professional offices as a permitted use within
the existing structure with appropriate exceptions to the development standards.
