BEING A BY-LAW to
amend Zoning By-law
Number 2213-78, as
amended (99 Wellington
Street East).
WHEREAS section 34 of the Planning Act, R.S.O. 1990, c. P.13, as amended,
provides that the councils of local municipalities may pass zoning by-laws;
AND WHEREAS the Council of The Corporation of the Town of Aurora (the "Town")
enacted By-law Number 2213-78, including amendments thereto (the 'Zoning By-
law");
AND WHEREAS the Council of the Town deems it necessary and expedient to
further amend the Zoning By-law;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
AURORA HEREBY ENACTS AS FOLLOWS:
1. THAT the Zoning By-law be and is hereby amended to replace the "Special
Mixed Density Residential (R5) Zone" zoning category applying to the lands
shown in hatching on Schedule "A" attached hereto and forming part of this
By-law with "Special Mixed Density Residential (R5-38) Exception Zone".
2. THAT the Zoning By-law be and is hereby amended to add the following:
"14.3.38 SPECIAL MIXED DENSITY RESIDENTIAL (R5-38)
EXCEPTION ZONE
14.3.38.1 Uses Permitted
In addition to the uses permitted in Section 14.1, the existing
building on the lands zoned R5-38 on Schedule "A" may also be
used for business and professional offices.
14.3.38.2 Zone Requirements
14.3.38.2.1 Lot Specifications
Lot Frontage (minimum) 10.5 metres
14.3.38.2.2 Siting Specifications
In accordance with Section 14.2.2.1, with the exception of the
following:
Interior Side Yard (minimum) 0.33 metres

14.3.38.2.3 Accessory Buildings and Uses
Notwithstanding the provisions of Section 6.2.2, accessory
buildings and structures shall be set back a minimum distance
of 0.2 metres from the lot lines adjacent to 97 Wellington Street
East and 95 Wellington Street East.
14.3.38.2.4 Yard and Setback Encroachments Permitted
Notwithstanding the provisions of Section 6.48.1, open -sided
roofed porches not exceeding one storey in height may
encroach a maximum of 2.95 metres into the required front
yard; and steps may encroach a maximum of 4.25 metres into
the required front yard.
14.3.38.2.5 Parking Space Requirements
Notwithstanding the provisions of Section 6.26.1.4, six (6)
parking spaces shall be provided.
14.3.38.2.6 Design, Construction and Location
Notwithstanding the provisions of Section 6.27.8(a), ingress and
egress, to and from the required parking spaces and areas shall
be provided by means of unobstructed driveways or
passageways at 2.6 metres in width with a minimum of 2.9
metres in width at the street line.
14.3.38.2.7 Buffer Strip
Notwithstanding the provisions of Section 6.31, a buffer strip is
not required except abutting the rear lot as shown on Schedule
„A„
3. THAT all other terms, provisions, and existing amendments of the Zoning By-
law remain the same.
4. THAT this By-law shall come into full force subject to compliance with the
provisions of the Planning Act, R.S.O. 1990, c. P. 13, as amended, and
subject to compliance with such provisions, this By-law will take effect from
the date of final passage hereof.

Explanatory Note
Re: Zoning By-law Number 5490-13
By-law Number 5490-13 has the following purpose and effect:
To amend By-law Number 2213-78, as amended, being the Zoning By-law in effect
in the Town of Aurora, to rezone the subject lands from "Special Mixed Density
Residential (R5) Zone" to "Special Mixed Density Residential (R5-38) Exception
Zone".
The rezoning will permit the existing building on the lands to be used for business
and professional offices.
