BYLAW - ZBA 64 Wells St - 20130226 - 548113THE CORPORATION OF THE TOWN OF AURORA By-law Number 5481-13 BEING A BY-LAW to amend Zoning By-law Number 2213-78, as amended (64 Wells Street). WHEREAS section 34 of the Planning Act, R.S.O. 1990, c. P.13, as amended, provides that the councils of local municipalities may pass zoning by-laws; AND WHEREAS the Council of The Corporation of the Town of Aurora (the "Town") enacted By-law Number 2213-78, including amendments thereto (the "Zoning By- law"); AND WHEREAS the Council of the Town deems it necessary and expedient to further amend the Zoning By-law; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF AURORA HEREBY ENACTS AS FOLLOWS: 1 THAT the Zoning By-law be and is hereby amended to replace the "Institutional (1) Zone" zoning category applying to the lands shown in hatching on Schedule "A" attached hereto and forming part of this By-law with "Third Density Apartment Residential (RA3-12) Zone". 2. THAT the Zoning By-law be and is hereby amended to add the following: "18.14 THIRD DENSITY APARTMENT RESIDENTIAL (RA3-12) EXCEPTION ZONE 18.14.1 Uses Permitted The lands zoned RA3-12 on Schedule "A" shall be used only for one apartment dwelling having a maximum of 39 units. 18.14.2 Zone Requirements 18.14.2.1 Siting Specifications Front Yard (minimum) 9.0 metres Side Yard (North minimum) 10.0 metres Side Yard (South minimum) 4.5 metres Rear Yard (minimum) 25.0 metres 18.14.2.2 Building Specifications In accordance with Section 18.2.3, with the exception that: By-law Number 5481-13 Page 2 of 3 i) the maximum Lot Coverage shall be 38 percent; and ii) the maximum Building Height shall be 4 storeys or 19.5 metres, whichever is greater. 18.14.2.3 Parking Space Requirements Notwithstanding the provisions of Section 6.26.1.2, the Minimum Parking Required shall be 47 spaces, and three of the 47 spaces shall be set aside for and visually identified as visitor's parking. 18.14.2.4 Off-street Parking in Yards Notwithstanding the provisions of Section 6.27.7, a maximum of 3 parking spaces shall be permitted in the front yard. 18.14.2.5 Accessory Buildings and Uses Notwithstanding the provisions of Section 6.2.2 and 6.2.3, an accessory parking garage shall be permitted in the rear yard provided that the minimum distance from any property line shall be 0.9 metres and the maximum height shall be 4.0 metres. 18.14.2.6 Amenity Area Notwithstanding the provisions of Section 7.2, the required amenity area may be permitted in the front yard, indoors, and above grade level. 18.14.2.7 Buffer Strip Notwithstanding provisions of Section 6.31.2 ii), there shall be a minimum 0.8 metre grass strip containing a solid wood fence of a minimum height of 1.5 metres." 3. THAT all other terms, provisions, and existing amendments of the Zoning By- law remain the same. 4. THAT this By-law shall come into full force subject to compliance with the provisions of the Planning Act, R.S.O. 1990, c. P. 13, as amended, and subject to compliance with such provisions, this By-law will take effect from the date of final passage hereof. READ A FIRST AND SECOND TIME THIS 26TH DAY OF FEBRUARY, 2013. Appprrovedas to form �9yL Signature A�'``' Date: GCO� By-law Number 5481-13 Page 3 of 3 Explanatory Note Re: Zoning By-law Number 5481-13 By-law Number 5481-13 has the following purpose and effect: To amend By-law Number 2213-78, as amended, being the Zoning By-law in effect in the Town of Aurora, to rezone the subject lands from "Institutional (1) Zone" to "Third Density Apartment Residential (RA3-12) Zone". The rezoning will permit the conversion of the former Wells Street School into a residential apartment containing a maximum of 39 units.
