BEING A BY-LAW to acquire
lands for municipal purposes
(Lebovic Enterprises Limited and
Revlis Securities Limited).
WHEREAS Section 5(3) of the Municipal Act, 2001, S.O. 2001, c.25, as amended
(hereinafter the "Act') states that a municipal power, including a municipality's capacity,
rights, powers and privileges under section 9 of the Act, shall be exercised by by-law
unless the municipality is specifically authorized to do otherwise;
AND WHEREAS The Corporation of the Town of Aurora deems it necessary and
expedient to acquire for municipal purposes the lands described on Schedule "A"
attached hereto and forming part of this By-law (hereinafter the "Lands");
AND WHEREAS The Corporation of the Town of Aurora and Lebovic Enterprises
Limited and Revlis Securities Limited entered into an Agreement of Purchase and Sale
dated July 20, 2012, respecting the Town's purchase of the Lands (hereinafter the
"Offer"), which Offer is conditional on the enactment of the applicable by-law to acquire
the Lands;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF
AURORA ENACTS AS FOLLOWS:
THAT the purchase of the Lands for municipal purposes be approved in
accordance with the recommendations set out in Closed Session Report No.
CAOI2-013 as considered by General Committee on the 17th day of July, 2012,
and subsequently adopted by Council on the 17th day of July, 2012.
2. THAT the Mayor and Clerk be authorized to execute all documents and ancillary
agreements as may be required to give effect to the purchase of the Lands.
3. THAT the provisions of this By-law shall come into full force and effect upon final
passage hereof.
