BYLAW - OPA 1 13900 Leslie St - 20120926 - 545212THE CORPORATION OF THE TOWN OF AURORA By-law Number 5452-12 BEING A BY-LAW to adopt Official Plan Amendment No. 1. WHEREAS the Council of The Corporation of the Town of Aurora (hereinafter the "Town") enacted By-law Number 5285-10, including any amendments thereto (hereinafter the "Official Plan"); AND WHEREAS the Council of the Town enacted By-law Number 4468-03.D, including any amendments thereto (hereinafter "OPA No. 48"); AND WHEREAS authority is given to Council pursuant to the Planning Act, R.S.O. 1990, c. P.13, as amended, to pass a by-law amending the Official Plan and OPA No. 48; AND WHEREAS the Town deems it necessary and expedient to further amend the Official Plan and OPA No. 48; NOW THEREFORE THE TOWN HEREBY ENACTS AS FOLLOWS: 1. THAT Official Plan Amendment No. 1 attached hereto is hereby adopted. 2. THAT all other terms, provisions, and existing amendments of the Official Plan and OPA No. 48 shall remain the same. 4. THAT this By-law shall come into force subject to compliance with the provisions of the Planning Act, R.S.O, 1990, c. P.13, as amended, and subject to compliance with such provisions, this By-law will take effect from the date of final passage hereof. READ A FIRST AND SECOND TIME THIS 26TH DAY OF SEPTEMBER, 2012. P.13, as amended. Implementation and Interpretation Page 4 PART I — THE PREAMBLE 1. Introduction This part of the Official Plan Amendment No. 1 (hereinafter the "Amendment") entitled Part I — The Preamble, explains the purpose and location of this Amendment, and provides an overview of the reasons for it. It is for explanatory purposes only and does not form part of the Amendment. 2. Purpose of the Amendment The purpose of this Amendment is to apply a site specific policy to permit a Place of Worship within the existing residential dwelling on the subject lands. 3. Location The lands affected by this Amendment are located on the west side of Leslie Street north of Bloomington Road and are municipally known as 13900 Leslie Street. The lands have a lot area of approximately 2.23 hectares (5.51 acres) and are legally described as Part Lots 11 and 12, Concession 2, EYS, designated as Part 1, Plan 65R-16275, Town of Aurora, Regional Municipality of York (hereinafter the "Subject Lands"). 4. Basis of the Amendment The basis of the Amendment is as follows: 4.1 The "Oak Ridges Moraine Countryside Area" policies of the Town's Official Plan do not include a Place of Worship as a permitted land use whereas the policies of the Oak Ridges Moraine Conservation Plan permit "small-scale commercial, industrial and institutional uses" such as a Place of Worship within the "Countryside Area". 4.2 Applications for amendments to the Official Plan and Zoning By-law were submitted to the Town of Aurora for consideration in August 2006 to permit a Place of Worship on the Subject Lands, however these applications were not considered complete until early 2011. Page 5 4.3 A Public Planning Meeting was held on April 27, 2011 to obtain input from members of the public and the Town's Council. 4.4 The Region of York determined that the proposal did not meet its in -force 1994 York Region Official Plan policies and that a Regional Official Plan Amendment ("ROPA") was also required to establish the Place of Worship land use on the Subject Lands. A ROPA application was submitted to the Region of York and a Public Meeting regarding said application was held on May 2, 2012. 4.5 This Amendment is desirable for the appropriate development and use of the Subject Lands on the following basis: • the proposed Place of Worship will utilize existing buildings and infrastructure, thereby minimizing disturbance to the Subject Lands; and • the Place of Worship land use as proposed is compatible with the surrounding residential and rural land uses. 4.6 Site Plan control will ensure that any improvements/alterations to the Subject Lands to facilitate the Place of Worship land use integrates well with adjacent land uses and will maintain the integrity of the Oak Ridges Moraine Countryside lands. PART II — THE AMENDMENT 1. Introduction All of this part of the document entitled Part II — The Amendment, consisting of the following text, constitutes Amendment No. 1 to the Official Plan. 2. Details of the Amendment The Official Plan is hereby amended as follows: Item (1): "Schedule "A", Land Use Plan, Official Plan Amendment No. 48, is amended by changing the land use designation for the Subject Lands from "Oak Ridges Moraine Countryside Area" to "Oak Ridges Moraine Countryside Area — Special", as shown on Schedule "A" — Land Use Plan, attached hereto and forming part of this Amendment." Page 6 Item (2): Section 3.13.4 e of Official Plan Amendment 48 — Oak Ridges Moraine is hereby amended by adding the following: "3.13.4 e x Oak Ridges Moraine Countryside Area - Special (OPA 1) The following special policies shall apply to the 2.23 hectares (5.51 acres) lands designated as "Oak Ridges Moraine Countryside Area —Special" municipally known as 13900 Leslie Street and legally described as Part Lots 11 and 12, Concession 2, EYS, designated as Part 1, Plan 65R- 16275, Town of Aurora, Regional Municipality of York. a) a Place of Worship shall be permitted within the existing 1,340m2 (14,424ft2) two storey detached residential dwelling and shall occupy a maximum of 575m2 (6,190m2) of said dwelling. The remainder of the dwelling shall be used for residential purposes; b) the second existing detached dwelling, being a 110m2 (1,184ft2) one storey building shall only be used as a guest house; and c) all other provisions of the "Oak Ridges Moraine Countryside Area" designation and OPA 48 shall continue to apply." Item (3) "Schedule "H", Site Specific Policy Areas being part of the Town of Aurora Official Plan, is amended by adding site specific policy area 36. Item (4): Section 16 of the Town of Aurora Official Plan, as amended, is hereby amended by adding the "Details of the Amendment — Official Plan Amendment 1". 3. Implementation and Interpretation This Amendment has been considered in accordance with the provisions of the Official Plan. The implementation and interpretation of this Amendment shall be in accordance with the respective policies of the Official Plan.
