BYLAW - ZBA 78 Wellington St E - 20120925 - 545112THE CORPORATION OF THE TOWN OF AURORA By-law Number 5451-12 BEING A BY-LAW to amend Zoning By-law Number 2213-78, as amended (78 Wellington Street East). WHEREAS section 34 of the Planning Act, R.S.O. 1990, c. P.13, as amended, provides that the councils of local municipalities may pass zoning by-laws; AND WHEREAS the Council of The Corporation of the Town of Aurora (hereinafter the "Town") enacted By-law Number 2213-78, including amendments thereto (hereinafter the "Zoning By-law"); AND WHEREAS the Council of the Town deems it necessary and expedient to further amend the Zoning By-law; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF AURORA HEREBY ENACTS AS FOLLOWS: 1. THAT the Zoning By-law be and is hereby amended to replace the "Special Mixed Density Residential (R5) Zone" zoning category applying to the lands shown in hatching on Schedule "A" attached hereto and forming part of this By-law with "Special Mixed Density Residential (R5-37) Exception Zone". 2. THAT the Zoning By-law be and is hereby amended to add the following: "14.3.37 SPECIAL MIXED DENSITY RESIDENTIAL (R5-37) EXCEPTION ZONE 14.3.37.1 Uses Permitted In addition to the uses permitted in Section 14.1, the existing building on the lands zoned R5-37 on Schedule "A" may also be used for business and professional offices. 14.3.37.2 Parking 14.3.37.2.1 Notwithstanding the provisions of Section 6.26.1.4, a minimum of four (4) parking spaces shall be provided. 14.3.37.2.2 Notwithstanding the provisions of Section 6.26, the minimum manoeuvring space for ninety degree (901) parking spaces shall be 0.6 metres. Notwithstanding the provisions of Section 6.26, two (2) parking spaces shall have minimum dimensions of 2.7 metres by 5.3 metres and two (2) parking spaces shall have minimum dimensions of 2.43 metres by 5.3 metres. 14.3.37.2.3 The provisions of Section 6.28.1.i shall not apply. 14.3.37.3 Buffer Strip Notwithstanding the provisions of Section 6.31, the buffer strip requirements along the northerly, westerly and easterly property lines shall be in accordance with the following: By-law Number 5451-12 Page 2 of 3 a) along the northerly property limit, the buffer shall consist of a minimum 1.2 metre wide grassed strip and a minimum 1.5 metre high wooden privacy fence; b) along the westerly property limit, the buffer shall consist of a minimum 1.5 metre wide grassed strip and a minimum 1.5 metre high wooden privacy fence extending from the north property limit to a point which is 12.14 metres from the south property limit; and c) along the easterly property limit, the buffer shall consist of a minimum 1.5 metre high wooden privacy fence extending from the north property limit to a point 3.57 metres from the. south property limit." 3. THAT all other terms, provisions, and existing amendments of the Zoning By- law remain the same. 4. THAT this By-law shall come into full force subject to compliance with the provisions of the Planning Act, R.S.O. 1990, c. P. 13, as amended, and subject to compliance with such provisions, this By-law will take effect from the date of final passage hereof. READ A FIRST AND SECOND TIME THIS 25TH DAY OF SEPTEMBER, 2012. The rezoning will permit the existing building on the lands to be used for business and professional offices. It will also permit reductions to parking and buffering requirements.
